Legislative Audit Committee. Current law requires the legislative audit committee to cause to be conducted performance audits of the automobile inspection and readjustment program every 5 years. The bill repeals this requirement.

Page 2, Line 2SECTION 1. In Colorado Revised Statutes, 42-4-316, repeal (2) and (3)(b) as follows:

legislative audit committee shall cause to be conducted performancePage 2, Line 6
audits of the program, including the clean screen program. The auditsPage 2, Line 7
must be completed not later than January 1, 2018, and January 1 of eachPage 2, Line 8
fifth year thereafter. Upon completion of the audit report, the legislative audit committee shall hold a public hearing to review the report.Page 2, Line 9(3) (b)
In such audits, the determination as to whether an ongoingPage 2, Line 10
public need for the program has been demonstrated shall take into consideration the following factors, among others:Page 2, Line 11
(I) The demonstrable effect on ambient air quality of the program;(II) The cost to the public of the program;Page 2, Line 12
(III) The cost-effectiveness of the program relative to other air pollution control programs;Page 2, Line 13
(IV) The need, if any, for further reduction of air pollution causedPage 2, Line 14
by mobile sources to attain or maintain compliance with national ambient air quality standards;Page 2, Line 15
(V) The application of the program to assure compliance with legally required warranties covering air pollution control equipment.Page 2, Line 16SECTION 2. Act subject to petition - effective date. This act
Page 2, Line 17takes effect at 12:01 a.m. on the day following the expiration of the
Page 2, Line 18ninety-day period after final adjournment of the general assembly; except
Page 3, Line 1that, if a referendum petition is filed pursuant to section 1 (3) of article V
Page 3, Line 2of the state constitution against this act or an item, section, or part of this
Page 3, Line 3act within such period, then the act, item, section, or part will not take
Page 3, Line 4effect unless approved by the people at the general election to be held in
Page 3, Line 5November 2026 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
