Concerning public hospital boards of trustees.
Be it enacted by the General Assembly of the State of Colorado:
SECTION 1. In Colorado Revised Statutes, 25-3-302, amend (1) as follows:
25-3-302. Board of trustees. (1) If a board of county commissioners decides to create a public hospital board of trustees, levy an annual tax, and appropriate funds to purchase, erect, and maintain or turn over to the public hospital board of trustees control of a county hospital, the board of county commissioners shall proceed at once to appoint to the public hospital board of trustees, for designated terms, seven trustees chosen from the citizens at large with reference to their fitness for office. All of the trustees must be residents of the county. and none may be an elected or appointed state, county, or city official. Nothing in this article 3 requires a licensed physician to be appointed to a public hospital board of trustees; however, if a licensed physician is appointed to a public hospital board of trustees, membership on that board is limited to one licensed physician at any given time. The seven appointees constitute the public hospital board of trustees for the public hospital. The public hospital board of trustees is a body corporate under the name "Board of Trustees for ............... Hospital", the name of the hospital being inserted in the blank.
SECTION 2. In Colorado Revised Statutes, 25-3-303, amend (1) introductory portion as follows:
25-3-303. Organization of trustees. (1) The members of the board of public hospital trustees within ten days after their appointment shall qualify by taking the oath of office. On the second Tuesday of each January, They shall annually organize and operate as follows:
SECTION 3. In Colorado Revised Statutes, 25-3-304, amend (2)(b) as follows:
25-3-304. Trustees - powers and duties. (2) (b) A board of public hospital trustees mustshall hold meetings at least once each month and mustshall keep a complete record of all its proceedings. Four members of the board constitutesconstitute a quorum for the transaction of business. One of the trustees must visit and examine said hospital at least twice each month, and the public hospital board, During the first week in each January and July, mustthe public hospital board shall file with the board of county commissioners a report of their proceedings with reference to such hospital and a statement of all receipts and expenditures during the half year. On or before each October firstDecember 1, the board mustshall certify to the board of county commissioners the amount necessary to maintain and improve said hospital for the ensuing year. NoA trustee shall not have a personal pecuniary interest, either directly or indirectly, in the purchase of any supplies for said hospital, unless the same are purchased by competitive bidding.
SECTION 4. Act subject to petition - effective date. This act takes effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly; except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2026 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
