Starting with the judicial department's 2026 "SMART Act" hearing, the bill requires the state court administrator to report statistics concerning restitution payments received and owed during the previous 5 state fiscal years.

Page 2, Line 1SECTION 1. In Colorado Revised Statutes, 13-3-101, add (13.5) as follows:

Page 2, Line 3definitions - repeal. (13.5) Notwithstanding section 24-1-136
Page 2, Line 4(11)(a)(I), during the 2026 regular session and each regular
Page 2, Line 5session thereafter, the state court administrator or the
Page 2, Line 6administrator's designee shall present at the judicial
Page 2, Line 7department's "SMART Act" hearing pursuant to section 2-7-203
Page 2, Line 8the following statistics concerning restitution for each of the previous five state fiscal years:
Page 2, Line 9(a) For cases that were eligible for a restitution order:
(I) The number of cases;
Page 2, Line 10(II) The number of cases in which restitution was requested;
Page 2, Line 11(III) The number of cases in which restitution was ordered; and
Page 2, Line 12(IV) The number of cases in which restitution was not requested;
Page 2, Line 13(b) The amount of restitution paid to:
(I) Individuals; and
Page 2, Line 14(II) Insurance companies;
Page 2, Line 15(c) The percentage of individuals owing restitution who are:
Page 2, Line 16(I) Asian;
(II) Black;
Page 2, Line 17(III) American Indian;
Page 2, Line 18(IV) Caucasian;
(V) Other race;
Page 3, Line 1(VI) Unknown race;
(VII) Hispanic;
Page 3, Line 2(VIII) Male;
(IX) Female;
Page 3, Line 3(X) Under twenty- five years of age;
Page 3, Line 4(XI) At least twenty-five years of age but under forty years of age;
Page 3, Line 5(XII) At least forty years of age but under sixty years of age; and
Page 3, Line 6(XIII) Sixty years of age or older;
Page 3, Line 7(d) For individuals who owe restitution, the percentage of individuals who owe restitution in each county;
Page 3, Line 8(e) For individuals who are in default on restitution payments for more than thirty days:
Page 3, Line 9(I) The number of individuals in default;
(II) The percentage of individuals in default who are:
Page 3, Line 10(A) Asian;
(B) Black;
Page 3, Line 11(C) American Indian;
(D) Caucasian;
Page 3, Line 12(E) Other race;
(F) Unknown race;
Page 3, Line 13(G) Hispanic;
(H) Male;
Page 3, Line 14(I) Female;
Page 3, Line 15(J) Under twenty- five years of age;
Page 4, Line 1(K) At least twenty-five years of age but under forty years of age;
Page 4, Line 2(L) At least forty years of age but under sixty years of age; and
Page 4, Line 3(M) Sixty years of age or older;
Page 4, Line 4(III) The total principal amount and the total interest owed by the individuals in default;
Page 4, Line 5(IV) The average length of time that the individuals have been in default; and
Page 4, Line 6(f) For individuals who are in default on restitution
Page 4, Line 7payments, the percentage of individuals who are in default in each county.
Page 4, Line 9SECTION 2. Act subject to petition - effective date. This act
Page 4, Line 10takes effect at 12:01 a.m. on the day following the expiration of the
Page 4, Line 11ninety-day period after final adjournment of the general assembly; except
Page 4, Line 12that, if a referendum petition is filed pursuant to section 1 (3) of article V
Page 4, Line 13of the state constitution against this act or an item, section, or part of this
Page 4, Line 14act within such period, then the act, item, section, or part will not take
Page 4, Line 15effect unless approved by the people at the general election to be held in
Page 4, Line 16November 2026 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
