The bill prohibits the discharge of plastic pellets and other preproduction plastic materials through land application or into state waters, wastewater, storm water runoff, or other runoff by a facility, point source, or person that makes, uses, handles, packages, or transports plastic pellets or other preproduction plastic materials in the state.

Page 4, Line 14(b) "Facility" means a facility where preproduction
Page 4, Line 15plastic materials are manufactured, handled, or transported in
Page 4, Line 16the state.
Page 4, Line 17(c) "Land application" means a discharge being applied to
Page 4, Line 18the land.
Page 4, Line 19(d) "Preproduction plastic materials" has the meaning set
Page 4, Line 20forth in section 25-8-1102.
Page 4, Line 21(2) The discharge of plastic pellets or other
Page 4, Line 22preproduction plastic materials from a facility is prohibited.
Page 4, Line 23(3) A person that makes, uses, packages, or transports
Page 4, Line 24plastic pellets or other preproduction plastic materials shall
Page 4, Line 25not discharge plastic pellets or other preproduction plastic
Page 4, Line 26materials in the state.
Page 4, Line 27SECTION 5. Act subject to petition - effective date -
Page 5, Line 1applicability. (1) This act takes effect at 12:01 a.m. on the day following
Page 5, Line 2the expiration of the ninety-day period after final adjournment of the
Page 5, Line 3general assembly (August 12, 2026, if adjournment sine die is on May 13,
Page 5, Line 42026); except that, if a referendum petition is filed pursuant to section 1
Page 5, Line 5(3) of article V of the state constitution against this act or an item, section,
Page 5, Line 6or part of this act within such period, then the act, item, section, or part
Page 5, Line 7will not take effect unless approved by the people at the general election
Page 5, Line 8to be held in November 2026 and, in such case, will take effect on the
Page 5, Line 9date of the official declaration of the vote thereon by the governor.
Page 5, Line 10(2) This act applies to conduct occurring on or after the applicable
Page 5, Line 11effective date of this act.
