Concerning the continuation of the motorcycle operator safety training program in the office of the chief of the state patrol in the department of public safety, and, in connection therewith, implementing the sunset review recommendations of the department of regulatory agencies.
Be it enacted by the General Assembly of the State of Colorado:
SECTION 1. In Colorado Revised Statutes, 24-34-104, repeal (26)(a)(XII); and add (31)(a)(XVI) as follows:
24-34-104. General assembly review of regulatory agencies and functions for repeal, continuation, or reestablishment - legislative declaration - repeal. (26) (a) The following agencies, functions, or both, are scheduled for repeal on September 1, 2025:
(XII) The motorcycle operator safety training program created in part 5 of article 5 of title 43.
(31) (a) The following agencies, functions, or both, are scheduled for repeal on September 1, 2030:
(XVI) The motorcycle operator safety training program created in part 5 of article 5 of title 43.
SECTION 2. In Colorado Revised Statutes, amend 43-5-507 as follows:
43-5-507. Repeal of part. This part 5 is repealed, effective September 1, 2025September 1, 2030. Before the repeal, this part 5 is scheduled for review in accordance with section 24-34-104.
SECTION 3. In Colorado Revised Statutes, 43-5-503, amend (2)(a) as follows:
43-5-503. MOST instructor requirements and training. (2) To be eligible, each applicant for an instructor certificate must:
(a) Be at least twenty-oneeighteen years of age; and
SECTION 4. In Colorado Revised Statutes, 43-5-501, amend (3.6) as follows:
43-5-501. Definitions. As used in this part 5, unless the context otherwise requires:
(3.6) "MOST vendor" means a person that offers a motorcycle operator safety training program that meets standards promulgated by the department of transportationstate patrol.
SECTION 5. In Colorado Revised Statutes, 43-5-504, add (4) as follows:
43-5-504. Motorcycle operator safety training fund - tuition benefit - definitions. (4) (a) Notwithstanding any provision of this section to the contrary, the chief may expend money from the fund for a tuition benefit paid to MOST vendors to be passed on to eligible students in the form of reduced costs for eligible courses as provided in this subsection (4).
(b) To be eligible to receive a tuition benefit to pass on to eligible students, a MOST vendor shall provide a receipt establishing that the tuition benefit was passed on to an eligible student who fully completed the training and any other documentation required by the chief as established by rule.
(c) The chief shall determine the allocation for a MOST vendor for the tuition benefit allowed in this subsection (4) based on the following factors, or as otherwise provided by rule:
(I) The amount of money in the fund;
(II) For a MOST vendor that has been certified for over two years, the historical data for eligible students and eligible courses over the previous two years; or
(III) For a MOST vendor that has been certified for two years or less, the available historical data for eligible students and eligible courses or an estimate of the eligible students and eligible courses.
(d) As used in this subsection (4), unless the context otherwise requires:
(I) "Eligible course" means a certified motorcycle operator safety training course that meets all requirements established by rule.
(II) "Eligible student" means an individual who is eligible to enroll in an eligible course and who meets all other requirements established by rule.
(e) The chief may adopt rules as necessary for the implementation of this subsection (4).
SECTION 6. Act subject to petition - effective date. This act takes effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly; except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2026 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
