Bill Summary

Joint Budget Committee. The bill allows the Centennial correctional facility-south c-tower to be used to temporarily house protective-, close-, and medium-custody inmates for the duration of the Sterling correctional facility access controls project. The bill limits the use of the Centennial correctional facility-south c-tower to only after the department of corrections determines that there are no suitable beds available to house an inmate in another department facility.
The bill appropriates $1,829,000 from the general fund to the department of corrections to implement the bill.

Page 2, Line 2SECTION 1. Legislative declaration. The general assembly
Page 2, Line 3finds that the temporary use of c-tower at Centennial correctional
Page 2, Line 4facility-south is necessary to accommodate the impact of the access
Page 2, Line 5controls capital renewal project at the Sterling correctional facility. It is
Page 2, Line 6the general assembly's intent that major accommodations of this kind be considered by the capital development committee in the future.
Page 2, Line 7SECTION 2. In Colorado Revised Statutes, 17-1-104.3, add (1)(b.6) as follows:

Page 2, Line 9report - repeal. (1) (b.6) (I) Notwithstanding any other provision
Page 2, Line 10of law to the contrary, the Centennial correctional
Page 2, Line 11facility-south c-tower may be used to temporarily house
Page 2, Line 12protective-, close-, and medium-custody inmates for the Sterling
Page 2, Line 13correctional facility access controls project, for the duration
Page 2, Line 14of that project, and for the time required to temporarily
Page 2, Line 15relocate the inmates and then return them to the Sterling
Page 2, Line 16correctional facility. To the extent feasible, the department
Page 2, Line 17shall house an inmate from the Sterling correctional facility
Page 2, Line 18in the Centennial correctional facility-south c-tower only
Page 2, Line 19after determining that there are no suitable beds available
Page 2, Line 20that would not require additional appropriations to house that
Page 3, Line 1inmate in another facility operated by the department of corrections.
Page 3, Line 2(II) The department shall, at least thirty days prior to
Page 3, Line 3relocating any inmates pursuant to subsection (1)(b.6)(I) of this
Page 3, Line 4section, provide a structured relocation plan to the joint
Page 3, Line 5budget committee and the house of representatives judiciary
Page 3, Line 6committee and the senate judiciary committee, or their
Page 3, Line 7successor committees, and shall update those committees during the project. The plan must include, but is not limited to:
Page 3, Line 8(A) What specific educational, rehabilitative, and
Page 3, Line 9vocational programs or classes will be available to the
Page 3, Line 10inmates, including the type of programs, the number of inmates
Page 3, Line 11that can be enrolled in each program, the length of each
Page 3, Line 12program, and the location where each program will be delivered;
Page 3, Line 13(B) What behavioral health and medical care will be available;
Page 3, Line 14(C) What employment opportunities will be available and the rate of pay for each employment opportunity;
Page 3, Line 15(D) What recreational opportunities will be available,
Page 3, Line 16including the location and length of time that an inmate will be able to access the recreational opportunities;
Page 3, Line 17(E) What visitation opportunities will be available, how
Page 3, Line 18often they will be available, the location for visitation, and whether that visitation is contact or non-contact;
Page 3, Line 19(F) How many hours a day an inmate will be allowed out
Page 3, Line 20of their cell based on their medium or close custody level or protective custody status;
Page 4, Line 1(G) Whether, prior to transfer, the department plans to
Page 4, Line 2conduct a reclassification or other custody review on any
Page 4, Line 3medium security inmate to determine whether the inmate is
Page 4, Line 4appropriate to progress or have an override to minimum-restrictive custody; and
Page 4, Line 5(H) An estimate of how long inmates will be temporarily
Page 4, Line 6held at Centennial correctional facility-south c-tower and if
Page 4, Line 7the relocations will be based on the duration of the access controls project at the Sterling correctional facility.
Page 4, Line 8(III) The department shall provide updates on the status
Page 4, Line 9of the access controls project at its"SMART Act" hearing required by section 2-7-203.
Page 4, Line 10(IV) This subsection (1)(b.6) is repealed, effective June 30, 2027.
Page 4, Line 11SECTION 3. Appropriation. For the 2025-26 state fiscal year,
Page 4, Line 12$1,829,000 is appropriated to the department of corrections for use by
Page 4, Line 13institutions. This appropriation is from the general fund. To implement
Page 4, Line 14this act, the institutions may use this appropriation for Centennial
Page 4, Line 15correctional facility-south c-tower start-up costs related to the superintendents subprogram.
Page 4, Line 16SECTION 4. Safety clause. The general assembly finds,
Page 4, Line 17determines, and declares that this act is necessary for the immediate
Page 4, Line 18preservation of the public peace, health, or safety or for appropriations for
Page 4, Line 19the support and maintenance of the departments of the state and state institutions.
