Bill Summary

The bill requires the state board of education to adopt high school health education standards regarding drug overdose risks, identification of a drug overdose event, and drug overdose prevention and response. The bill authorizes the state board of education to seek, accept, and expend gifts, grants, or donations for the purpose of adopting these standards.
The bill authorizes a school district, the state charter school institute, a public school, or a nonpublic school to seek, accept, and expend gifts, grants, or donations for purposes related to maintaining, administering, and furnishing opioid antagonists.

Page 2, Line 2SECTION 1. In Colorado Revised Statutes, 22-7-1005, add (2.9) as follows:

Page 2, Line 5of statutes. (2.9) (a) On or before July 1, 2028, the state board
Page 2, Line 6shall ensure that the ninth through twelfth grade health
Page 2, Line 7standards identify the knowledge and skills that a student
Page 2, Line 8should acquire relating to drug overdoses, including fentanyl
Page 2, Line 9and other opioid-related drug overdoses. The standards must
Page 2, Line 10include evidence-based knowledge and skills regarding drug
Page 2, Line 11overdose risks, identification of a drug overdose event, and
Page 2, Line 12drug overdose prevention and response, and must promote positive social norms concerning the knowledge and skills.
Page 2, Line 13(b) The state board may seek, accept, and expend gifts,
Page 2, Line 14grants, or donations from private or public sources for the purposes of this subsection (2.9).
Page 2, Line 15(c) (I) The requirement to complete the duty described
Page 2, Line 16pursuant to subsection (2.9)(a) of this section on or before July
Page 2, Line 171, 2027 is contingent on money being available to perform the
Page 2, Line 18duty on or before July 1, 2027. If money is not available for the
Page 2, Line 19state board, the department of education, or any other entity
Page 2, Line 20necessary to perform the duty required pursuant to subsection
Page 3, Line 1(2.9)(a) of this section on or before July 1, 2027, the state board
Page 3, Line 2is not required to perform the duty until on or before July 1,
Page 3, Line 32028, pursuant to the standard schedule described in section (6) of this section.

Page 3, Line 61, 2027 takes effect if the state board receives twenty thousand

Page 3, Line 11subsection (2.9)(c)(II) has occurred by emailing the notice to revisorofstatutes.ga@coleg.gov.

Page 4, Line 13school, or a nonpublic school may seek, accept, and expend gifts,

Page 4, Line 15purposes of this section, including acquiring and maintaining a
Page 4, Line 16stock supply of opioid antagonists pursuant to subsection (1)(a)
Page 4, Line 17of this section, providing training to employees or agents to be
Page 4, Line 18eligible to administer an opioid antagonist pursuant to
Page 4, Line 19subsection (1)(b) of this section, and providing training to students.
Page 4, Line 20SECTION 3. Act subject to petition - effective date. This act
Page 4, Line 21takes effect at 12:01 a.m. on the day following the expiration of the
Page 4, Line 22ninety-day period after final adjournment of the general assembly; except
Page 4, Line 23that, if a referendum petition is filed pursuant to section 1 (3) of article V
Page 4, Line 24of the state constitution against this act or an item, section, or part of this
Page 4, Line 25act within such period, then the act, item, section, or part will not take
Page 5, Line 1effect unless approved by the people at the general election to be held in
Page 5, Line 2November 2026 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
