Concerning suspending legislative interim activities, and, in connection therewith, making and reducing an appropriation.
Be it enacted by the General Assembly of the State of Colorado:
SECTION 1. In Colorado Revised Statutes, 2-3-303.3, add (3)(e) and (3)(f) as follows:
2-3-303.3. Interim committees - repeal. (3) (e) (I) Notwithstanding any provision of this section, the legislative council shall not prioritize any interim committees or approve any task forces for the 2025 interim. Nothing in this subsection (3)(e) prohibits the executive committee of the legislative council, whether before or after the general assembly has adjourned, from approving an interim committee by resolution for the 2025 interim in the manner specified in subsection (3)(c) of this section.
(II) This subsection (3)(e) is repealed, effective July 1, 2026.
(f) (I) During the 2025 interim, an interim committee shall not request more than five bills to be drafted and shall not recommend more than three bills for introduction in the 2026 regular session.
(II) This subsection (3)(f) is repealed, effective July 1, 2026.
SECTION 2. In Colorado Revised Statutes, 2-2-1305.5, amend (1); and repeal (6)(a) as follows:
2-2-1305.5. Representative Hugh McKean Colorado youth advisory council review committee - created. (1) There is created in the legislative branch the Representative Hugh McKean Colorado youth advisory council review committee to review the council's work. and to recommend legislation regarding issues affecting Colorado youth. The committee is comprised of ten members, as described in subsection (2) of this section.
(6) (a) The review committee may recommend up to a total of three bills during each interim. Legislation recommended by the review committee must be treated as legislation recommended by an interim committee for purposes of applicable deadlines, bill introduction limits, and any other requirements imposed by the joint rules of the general assembly.
SECTION 3. In Colorado Revised Statutes, 2-3-1503, amend (1)(a) as follows:
2-3-1503. Legislative emergency preparedness, response, and recovery committee - creation - membership - duties - repeal. (1) (a) (I) There is hereby created a legislative emergency preparedness, response, and recovery committee. The legislative committee shall develop a plan for the response by, and continuation of operations of, the general assembly and the legislative service agencies in the event of an emergency epidemic or disaster. The legislative committee shall cooperate and coordinate with the division, the department, and the GEEERC in developing the plan. The legislative committee shall develop and submit the plan to the speaker of the house of representatives, the president of the senate, the governor, the executive director of the department, the director of the division, and the GEEERC no later than July 1, 2011. The legislative committee shall meet at least annually to review and amend the plan as necessary and shall provide any updated plan to the persons or entities specified in this paragraph (a)subsection (1)(a)(I). The legislative committee may recommend legislation pertaining to the preparedness, response, and recovery by, and continuation of operations of, the general assembly and the legislative service agencies in the event of an emergency epidemic or disaster. The legislative committee shall provide information to and fully cooperate with the division, the department, and the GEEERC in fulfilling its duties underpursuant to this section.
(II) (A) Notwithstanding subsection (1)(a)(I) of this section, the committee shall not meet or recommend legislation during the 2025 interim.
(B) This subsection (1)(a)(II) is repealed, effective July 1, 2026.
SECTION 4. In Colorado Revised Statutes, 2-3-1901, amend (2)(a); and add (2)(e)(V) as follows:
2-3-1901. Legislative oversight committee for Colorado jail standards - creation - duties - repeal. (2) Duties. (a) (I) The committee shall meet no more than four times each year.
(II) (A) Notwithstanding subsection (2)(a)(I) of this section, the committee shall not meet during the 2025 interim.
(B) This subsection (2)(a)(II) is repealed, effective July 1, 2026.
(e) (V) (A) Notwithstanding subsection (2)(e)(I) of this section, the committee shall not recommend legislation during the 2025 interim.
(B) This subsection (2)(e)(V) is repealed, effective July 1, 2026.
SECTION 5. In Colorado Revised Statutes, 10-16-221, add (3)(c) as follows:
10-16-221. Statewide health care review committee - creation - membership - duties - repeal. (3) (c) (I) Notwithstanding subsection (3)(a) of this section, the committee shall not meet or take field trips during the 2025 interim.
(II) This subsection (3)(c) is repealed, effective July 1, 2026.
SECTION 6. In Colorado Revised Statutes, 10-22-107, add (1)(c) and (5)(c) as follows:
10-22-107. Colorado health insurance exchange oversight committee - creation - duties - repeal. (1) (c) (I) Notwithstanding subsection (1)(a) of this section, the committee shall not meet during the 2025 interim.
(II) This subsection (1)(c) is repealed, effective July 1, 2026.
(5) (c) (I) Notwithstanding subsection (5)(a) of this section, the committee shall not report to the legislative council and shall not recommend legislation during the 2025 interim.
(II) This subsection (5)(c) is repealed, effective July 1, 2026.
SECTION 7. In Colorado Revised Statutes, 10-22.3-101, amend (3) as follows:
10-22.3-101. Opioid and other substance use disorders study committee - creation - members - purposes - repeal. (3) (a) The committee may meet up to six times per interim in the 2023 and 2025 interimsinterim. The committee may recommend up to a total of five bills during each interim. Legislation recommended by the committee must be treated as legislation recommended by an interim committee for purposes of applicable deadlines, bill introduction limits, and any other requirements imposed by the joint rules of the general assembly.
(b) By December 1, 2023, and December 1, 2025, the committee shall make a report and a final report, respectively, to the legislative council created in section 2-3-301 that may include recommendations for legislation.
SECTION 8. In Colorado Revised Statutes, 24-51.1-101, add (7) as follows:
24-51.1-101. Pension review commission - repeal. (7) (a) Notwithstanding any provision of this section, the commission and the subcommittee shall not meet during the 2025 interim and legislative members of the subcommittee are not required to attend the meetings and hearings specified in subsection (5) of this section during the 2025 interim. If a legislative member of the subcommittee attends a meeting or hearing specified in subsection (5) of this section during the 2025 interim, the legislative member is not entitled to per diem compensation. The subcommittee is not required to comply with the review and reporting requirements set forth in subsection (4) of this section during the 2025 interim.
(b) This subsection (7) is repealed, effective July 1, 2026.
SECTION 9. In Colorado Revised Statutes, 39-21-403, amend (2)(a)(I), (2)(d), and (2)(e) as follows:
39-21-403. Legislative oversight committee concerning tax policy - creation - duties - report -repeal. (2) Duties. (a) (I) (A) The committee shall meet at least four times each year and at such other times as it deems necessary.
(B) Notwithstanding subsection (2)(a)(I)(A) of this section, the committee shall not meet during the 2025 interim. This subsection (2)(a)(I)(B) is repealed, effective July 1, 2026.
(d) (I) The committee may recommend legislative changes that are treated as bills recommended by an interim legislative committee for purposes of any introduction deadlines or bill limitations imposed by the joint rules of the general assembly.
(II) (A) Notwithstanding subsection (2)(d)(I) of this section, the committee shall not recommend legislation during the 2025 interim.
(B) This subsection (2)(d)(II) is repealed, effective July 1, 2026.
(e) (I) On or before January 1 of each year, the committee shall submit, and make publicly available on its website, a report to the general assembly. The annual report must briefly summarize the study issues, recommendations considered, and any actions taken by the committee and the task force during the previous year. The report must comply with the provisions of section 24-1-136 (9). Notwithstanding section 24-1-136 (11)(a)(I), the requirement in this section to report to the general assembly continues indefinitely.
(II) (A) The committee shall not submit a report on or before January 1, 2026.
(B) This subsection (2)(e)(II) is repealed effective, July 1, 2026.
SECTION 10. In Colorado Revised Statutes, 39-26-802, amend (3) and (5) as follows:
39-26-802. Sales and use tax simplification task force - creation - definitions - repeal. (3) (a) Starting in 2021, the task force shall meet at least eight times, with the first meeting occurring no later than July 16, 2021. Task force meetings shall be open to the public, and the task force shall solicit the testimony of the members of the public.
(b) (I) Notwithstanding subsection (3)(a) of this section, the task force shall not meet during the 2025 interim.
(II) This subsection (3)(b) is repealed, effective July 1, 2026.
(5) (a) No later than November 1, 2021, and no later than each November 1 thereafter, the task force shall make a report to the legislative council created in section 2-3-301 that may or may not include recommendations for legislation.
(b) (I) Notwithstanding subsection (5)(a) of this section, the task force shall not make a report for the 2025 interim.
(II) This subsection (5)(b) is repealed, effective July 1, 2026.
SECTION 11. In Colorado Revised Statutes, 2-2-307, add (3)(d) as follows:
2-2-307. Compensation of members - reimbursement of expenses - definition - repeal. (3) (d) Notwithstanding this section or any other provision of law, a member of the general assembly who is appointed to a statutorily created interim committee is not entitled during the 2025 interim to per diem and travel expenses for attendance at a meeting of the interim committee during the 2025 interim, except for attendance at a meeting of the wildfire matters review committee created pursuant to section 2-3-1602, the water resources and agriculture review committee created pursuant to section 37-98-102, and the transportation legislation review committee created pursuant to section 43-2-145.
SECTION 12. In Colorado Revised Statutes, 2-3-1302, add (3) as follows:
2-3-1302. Capital development committee established. (3) The capital development committee shall not travel or take field trips during the 2025 interim.
SECTION 13. Appropriation - adjustments to 2025 legislative appropriation bill. (1) To implement this act, the total and general fund appropriations made to the legislative department in Senate Bill 25-188 for the 2025-26 state fiscal year are decreased by $272,355 as follows:
(a) The total and general fund appropriations for use by the general assembly are decreased by $71,948;
(b) The total and general fund appropriations for use by the legislative council are decreased by $104,161, and the related FTE is decreased by 1.3 FTE; and
(c) The general fund appropriation for use by the committee on legal services is decreased by $96,246, and the related FTE is decreased by 1.3 FTE.
SECTION 14. Appropriation. For the 2025-26 state fiscal year, $45,000 is appropriated to the youth advisory council cash fund created in section 2-2-1306, C.R.S. This appropriation is from the general fund. The legislative department is responsible for the accounting related to this appropriation.
SECTION 15. Safety clause. The general assembly finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, or safety or for appropriations for the support and maintenance of the departments of the state and state institutions.
