After consideration on the merits, the Committee recommends the following:

SB26-061     be amended as follows, and as so amended, be referred to the Committee of the Whole with favorable recommendation and with a recommendation that it be placed on the consent calendar:

Page 1, Line 3"SECTION 1.  In Colorado Revised Statutes, 24-70-103, amend

Page 1, Line 4(1) and (3); and add (1.5) as follows:

Page 1, Line 524-70-103.  Requisites of legal newspaper.

Page 1, Line 6(1)  Any and every legal notice or advertisement shall be published

Page 1, Line 7only in the following order of priority in a daily, a triweekly, a

Page 1, Line 8semiweekly, or a weekly newspaper of general circulation: and printed or

Page 1, Line 9published in whole or in part in the county in which such notice or

Page 1, Line 10advertisement is required to be published, except as provided in this

Page 1, Line 11section. The newspaper, if published triweekly, semiweekly, or weekly,

Page 1, Line 12shall have been so published in such county, except as provided in this

Page 1, Line 13section, continuously and uninterruptedly during the period of at least

Page 1, Line 14fifty-two consecutive weeks next prior to the first issue thereof containing

Page 1, Line 15any such notice or advertisement; and the newspaper, if published daily,

Page 1, Line 16shall have been so published in such county, uninterruptedly and

Page 1, Line 17continuously, during the period of at least six months next prior to the

Page 1, Line 18first issue thereof containing any such notice or advertisement. In the case

Page 1, Line 19of a municipality having territory in two counties, each of which counties

Page 1, Line 20has one or more legal newspapers within the municipality, the publication

Page 1, Line 21by such municipality of its legal notices and advertisements in one of such

Page 1, Line 22newspapers shall be construed as valid publication under this part 1.

Page 1, Line 23(a)  First, in such a newspaper that has been printed or

Page 1, Line 24published, in whole or in part, in the county in which the legal

Page 1, Line 25notice or advertisement is required to be published

Page 1, Line 26uninterruptedly and continuously for at least one year prior

Page 2, Line 1to the first issue containing the legal notice or advertisement

Page 2, Line 2and that satisfies the requirements of a legal publication

Page 2, Line 3specified in section 24-70-102;

Page 2, Line 4(b)  Second, in such a newspaper that has been printed or

Page 2, Line 5published, in whole or in part, in the county in which the legal

Page 2, Line 6notice or advertisement is required to be published

Page 2, Line 7uninterruptedly and continuously for at least one year prior

Page 2, Line 8to the first issue containing the legal notice or advertisement

Page 2, Line 9and that satisfies the requirements to be admitted to the United

Page 2, Line 10States mails with periodicals mailing privileges but for the

Page 2, Line 11absence of paid circulation that is distributed within the

Page 2, Line 12territorial boundaries of the county; or

Page 2, Line 13(c)  Third, in such a newspaper that has been printed or

Page 2, Line 14published, in whole or in part, in the county in which the legal

Page 2, Line 15notice or advertisement is required to be published that would

Page 2, Line 16otherwise satisfy the requirements of subsections (1)(a) or (1)(b)

Page 2, Line 17of this section but for the requirement that the newspaper shall

Page 2, Line 18have been published in the county uninterruptedly and

Page 2, Line 19continuously for at least one year prior to the first issue

Page 2, Line 20containing the legal notice or advertisement.

Page 2, Line 21(1.5)  If a municipality or special district has territory in

Page 2, Line 22two counties, each of which has one or more newspapers that

Page 2, Line 23satisfy the requirements of a legal publication specified in

Page 2, Line 24section 24-70-102 within the municipality or special district, the

Page 2, Line 25municipality or special district may publish notice in either

Page 2, Line 26newspaper.

Page 2, Line 27(3)  If in any county in this state no newspaper has been published

Page 2, Line 28for the prescribed period at the time when any such notice or

Page 2, Line 29advertisement is required to be published or if there is no newspaper

Page 2, Line 30published therein, such notice or advertisement may be published in any

Page 2, Line 31newspaper published in whole or in part in an adjoining county and

Page 2, Line 32having a general circulation in whole or in part in said county having no

Page 2, Line 33newspaper published therein. If there is no newspaper in any adjoining

Page 2, Line 34county that has been published for the prescribed period at the time when

Page 2, Line 35any such notice or advertisement is required to be published, a required

Page 2, Line 36notice or advertisement may be published in a newspaper having general

Page 2, Line 37circulation within the county. If none of the options applicable to

Page 2, Line 38any and every legal notice or advertisement set forth in

Page 2, Line 39subsection (1) of this section are available within the county in

Page 2, Line 40which publication of a legal notice or advertisement is required,

Page 2, Line 41the legal notice or advertisement may be published in an

Page 2, Line 42adjoining county in accordance with the same order of priority

Page 2, Line 43in subsection (1) of this section. If none of the options set forth

Page 3, Line 1in subsection (1) of this section are available in any adjoining

Page 3, Line 2county, the legal notice or advertisement may be published in a

Page 3, Line 3newspaper that satisfies the requirements for a legal

Page 3, Line 4publication specified in section 24-70-102, selected with primary

Page 3, Line 5consideration given to geographic proximity.

Page 3, Line 6SECTION 2.  Act subject to petition - effective date. This act

Page 3, Line 7takes effect at 12:01 a.m. on the day following the expiration of the

Page 3, Line 8ninety-day period after final adjournment of the general assembly (August

Page 3, Line 912, 2026, if adjournment sine die is on May 13, 2026); except that, if a

Page 3, Line 10referendum petition is filed pursuant to section 1 (3) of article V of the

Page 3, Line 11state constitution against this act or an item, section, or part of this act

Page 3, Line 12within such period, then the act, item, section, or part will not take effect

Page 3, Line 13unless approved by the people at the general election to be held in

Page 3, Line 14November 2026 and, in such case, will take effect on the date of the

Page 3, Line 15official declaration of the vote thereon by the governor.".
