Current law does not allow a voice court reporter to administer an oath or affirmation. The bill adds voice reporters to the list of professionals who may administer an oath or affirmation.

• Page 2, Line 2SECTION 1.  In Colorado Revised Statutes, amend 24-12-103 as follows:

• Page 2, Line 324-12-103.  Who may administer oaths or affirmations. (1)  All

• Page 2, Line 4courts in this state and each judge, justice, magistrate, referee, clerk, and

• Page 2, Line 5deputy clerk; thereof; court reporters who hold the registered professional

• Page 2, Line 6reporter, certified verbatim reporter, or certified verbatim

• Page 2, Line 7reporter - stenotype certification or higher; members and referees of

• Page 2, Line 8the division of labor standards and statistics; members of the public

• Page 2, Line 9utilities commission; and notaries public have power to administer oaths

• Page 2, Line 10or affirmations to witnesses and others concerning any a matter, thing,

• Page 2, Line 11process, or proceeding pending, commenced, or to be commenced before them. respectively.

• Page 2, Line 12(2)  The courts, judges, magistrates, referees, clerks, and deputy

• Page 2, Line 13clerks within their respective districts or counties; court reporters who

• Page 2, Line 14hold the registered professional reporter, certified verbatim reporter,

• Page 2, Line 15or certified verbatim reporter - stenotype certification or higher;

• Page 2, Line 16a person designated by the governing body, or any an officer thereof of

• Page 2, Line 17the body; and notaries public within any a county of this state have the

• Page 2, Line 18power to administer all oaths or affirmations of office and other oaths or

• Page 2, Line 19affirmations required to be taken by any a person upon any a lawful

• Page 2, Line 20occasion and to take affidavits and depositions concerning any a matter

• Page 2, Line 21or thing, process, or proceeding pending, commenced, or to be

• Page 2, Line 22commenced in any a court or on any an occasion an affidavit or a deposition is authorized or by law required to be taken.

• Page 2, Line 24determines, and declares that this act is necessary for the immediate

• Page 3, Line 1preservation of the public peace, health, or safety or for appropriations for

• Page 3, Line 2the support and maintenance of the departments of the state and state institutions.
