After consideration on the merits, the Committee recommends the following:
HB26-1197 be amended as follows, and as so amended, be referred to the Committee on Appropriations with favorable recommendation:

Page 1, Line 6(5) (a) "Vessel" means every description of watercraft type of
Page 1, Line 7watercraft, except a seaplane on the water, used or capable of
Page 1, Line 8being used as a means of transportation of persons and property on the
Page 1, Line 9water, including all types of stand-up paddleboards but does not
Page 1, Line 10include fishing aids, air mattresses, beach and water toys, or
Page 1, Line 11inner tubes.
Page 1, Line 12(b) "Vessel" does not include:
Page 1, Line 13(I) Any single-chambered, air-inflated devices that are not
Page 1, Line 14stand-up paddleboards; or
Page 1, Line 15(II) Seaplanes.
Page 1, Line 16(5.3) "Vessel livery" means a person that advertises and

Page 1, Line 19SECTION 4. In Colorado Revised Statutes, amend 33-13-107 as
Page 1, Line 20follows:
Page 1, Line 2133-13-107. Vessel liveries - repeal.
Page 1, Line 22(1) The owner or operator of A vessel livery shall keep a record
Page 1, Line 23of the name and address of each person who that hires any vessel that
Page 1, Line 24is designed or permitted to be operated as a vessel, the hull identification
Page 1, Line 25number of the vessel, and the departure date and time and the expected
Page 1, Line 26date and time of return of the vessel. Such records shall be preserved for
Page 1, Line 27at least thirty days three years after the vessel is to be returned and shall
Page 2, Line 1be are subject to inspection by the division. Any person who that
Page 2, Line 2violates this subsection (1) commits a civil infraction and, upon
Page 2, Line 3conviction, shall be punished by a fine of one hundred dollars.
Page 2, Line 4(2) Neither the owner nor operator of A vessel livery nor such
Page 2, Line 5owner's or operator's or the vessel livery's agent or employee shall
Page 2, Line 6not permit any vessel to depart from his or her the vessel livery's
Page 2, Line 7premises unless such vessel is equipped and registered as required by this
Page 2, Line 8article 13 and rules promulgated adopted pursuant to this article 13. Any
Page 2, Line 9person who that violates this subsection (2) commits a civil infraction
Page 2, Line 10and, upon conviction, shall be punished by a fine of one hundred dollars.

Page 2, Line 17not lease, hire, or rent a motorboat to or for operation by any individual
Page 2, Line 18under eighteen years of age years old; except that an individual fourteen
Page 2, Line 19years of age years old or older who has not reached the individual's
Page 2, Line 20eighteenth birthday may be permitted or authorized to operate a
Page 2, Line 21motorboat if the individual has met the boating safety and certificate
Page 2, Line 22requirements of subsection (2) of this section.
Page 2, Line 23(5) Any individual who person that violates this section
