Bill Summary

Current law requires an electrical employer, plumbing employer, or apprenticeship program registered with the United States department of labor or a state apprenticeship agency recognized by the United States department of labor that employs an apprentice in this state (employer) to register an apprentice with the employer's respective governing board (board) within 30 days after beginning employment. When an apprentice is no longer employed as an apprentice, the bill requires the employer to remove the apprentice from the apprenticeship program and notify the applicable board of the termination of the employment no later than 30 days after the termination of the employment.
On and after January 1, 2027, an employer is also required to renew an apprentice's registration with the employer's board at least once every 12 months. The employer must provide specified information to the board when renewing the apprentice's registration. The board may charge a registration fee to pay for the costs of maintaining an apprenticeship registration database.
An employer is prohibited from registering an apprentice's registration with a board unless the apprentice is enrolled in an apprenticeship program training the apprentice for an occupation officially recognized by the United States department of labor as an electrical occupation for an electrical apprenticeship or a plumbing occupation for a plumbing apprenticeship. Each calendar quarter, the state apprenticeship agency shall publish a list of the apprenticeship programs that train apprentices for an occupation officially recognized by the United States department of labor as an electrical occupation or a plumbing occupation.
On or before July 1, 2026, the bill requires the state apprenticeship agency and the department of regulatory agencies to establish data-sharing agreements and policies to enable the entities to determine if there are apprentices registered with a board who are enrolled to be trained for occupations other than electrical or plumbing occupations and who are therefore ineligible for registration with the board. If the board cannot verify that an apprentice is eligible to be registered as an apprentice within 30 days after notice of noncompliance, the board shall remove the apprentice's registration with the board, and the noncompliant apprentice shall not perform work as a plumbing or electrical apprentice in the state.
An employer of an electrical apprentice may authorize the electrical apprentice to take the residential wireman's license examination instead of the journeyman electrician license examination if:
- The employer determines that the relevant practical experience of the apprentice is best suited to pursue the residential wireman's license instead of a journeyman electrician license; or
- The employer determines that the apprentice would be more likely to achieve an electrical license by pursuing a residential wireman's license.
- The board determines that the apprentice has legitimate educational or professional circumstances that justify the exemption; or
- The apprentice has passed the residential wireman's license examination and is only performing residential electrical work.
- The employer determines that the relevant practical experience of the apprentice is best suited to pursue the residential plumber's license instead of a journeyworker plumber's license; or
- The employer determines that the apprentice would be more likely to achieve a plumber's license by pursuing a residential plumber's license.
- The board determines that the apprentice has legitimate educational or professional circumstances that justify the exemption; or
- The apprentice has passed the residential plumber's license examination and is only performing residential plumbing work.
If an electrical apprentice has failed to pass a license examination in 2 consecutive 3-year periods, the apprentice may request an exemption from the board from future examination requirements. The board shall grant the exemption if:
An employer of a plumbing apprentice may authorize the plumbing apprentice to take the residential plumber's license examination instead of the journeyworker plumber's license examination if:
If a plumbing apprentice has failed to pass a license examination in 2 consecutive 2-year periods, the plumbing apprentice may request an exemption from the board from future examination requirements. The board shall grant the exemption if:
Current law requires that, if the cumulative training and classroom hours of an apprentice are not properly reported to the board or if an apprentice fails to take a license examination within a specified time frame, the board shall suspend the apprentice's license. The bill allows the board to instead declare the apprentice's registration status "inactive" and creates procedures for the board to restore the apprentice's registration status to "active".
A board may sanction an employer that consistently and willfully demonstrates a lack of compliance or whose apprentices show a significant pattern of noncompliance with the bill.

Page 5, Line 19indicate whether the apprenticeship program is registered with
Page 5, Line 20the United States department of labor or a state apprenticeship agency.
Page 5, Line 21(C) For an apprentice who has been registered for at least
Page 5, Line 22six years, has completed eight thousand hours of practical
Page 5, Line 23training, and meets the journeyman electrician license
Page 6, Line 1requirements described in section 12-115-110 (2), the electrical
Page 6, Line 2contractor or apprenticeship program shall indicate if the
Page 6, Line 3apprentice has taken the journeyman electrician license
Page 6, Line 4examination as required by statute or if the apprentice has been granted an exemption by the board; and
Page 6, Line 5(D) The name and contact information of the apprentice,
Page 6, Line 6including a current email address, phone number, and mailing
Page 6, Line 7address. The registered electrical contractor or apprenticeship program shall update this information as necessary.

Page 6, Line 10the supervision of a licensed electrician using the information provided pursuant to this subsection (3)(d).

Page 6, Line 12registered electrical contractor or apprenticeship program
Page 6, Line 13that employs the apprentice provides the information required by subsection (3)(d)(I) of this section.
Page 6, Line 14(IV) The board may determine and charge reasonable
Page 6, Line 15registration fees to maintain the apprenticeship registration database established pursuant to this subsection (3)(d).

Page 7, Line 12agency and the department shall establish data-sharing agreements and policies, including performing the following:
Page 7, Line 13(I) At least once per calendar quarter, the state
Page 7, Line 14apprenticeship agency shall provide a list of the approved
Page 7, Line 15electrical apprenticeship programs that are registered with the
Page 7, Line 16state apprenticeship agency and a list of the apprentices
Page 7, Line 17registered in those programs who are eligible to register as
Page 7, Line 18electrical apprentices with the board pursuant to subsection(3.5)(a) of this section.
Page 7, Line 19(II) At least once per calendar quarter, the board shall
Page 7, Line 20provide the state apprenticeship agency a list of the electrical
Page 7, Line 21apprentices registered with the board. At a reasonable time
Page 7, Line 22after receipt of the list, the state apprenticeship agency shall
Page 7, Line 23provide the board with a list of electrical apprentices
Page 8, Line 1registered with the board who are enrolled to be trained for
Page 8, Line 2occupations other than electrical occupations and who are
Page 8, Line 3therefore ineligible for registration with the board pursuant to
Page 8, Line 4subsection (3.5)(a) of this section. The board shall review the
Page 8, Line 5list sent by the state apprenticeship agency to determine if the
Page 8, Line 6electrical apprentices are in compliance with subsection (3.5)(a) of this section.
Page 8, Line 7(III) The board shall indicate, for each electrical
Page 8, Line 8apprentice registered with the board, if the apprentice's registration is sponsored by:
Page 8, Line 9(A) An electrical contractor;
Page 8, Line 10(B) An electrical training program that is not an
Page 8, Line 11apprenticeship program registered with the United States
Page 8, Line 12department of labor or a state apprenticeship agency recognized by the United States department of labor; or
Page 8, Line 13(C) An electrical apprenticeship program registered with
Page 8, Line 14the United States department of labor or a state apprenticeship agency.
Page 8, Line 15(c) (I) If the board determines that an apprentice is not in
Page 8, Line 16compliance with subsection (3.5)(a) of this section, the board
Page 8, Line 17shall notify the electrical contractor or apprenticeship
Page 8, Line 18program that registered the apprentice with the board. Within
Page 8, Line 19thirty days after notification of noncompliance, the electrical
Page 8, Line 20contractor or apprenticeship program shall provide proof that
Page 8, Line 21the apprentice is eligible to be registered as an electrical
Page 8, Line 22apprentice with the board. If the board verifies within thirty
Page 8, Line 23days after notification of noncompliance that the apprentice is
Page 9, Line 1eligible to be registered as an electrical apprentice, the apprentice will remain registered with the board.

Page 9, Line 3eligible to be registered as an electrical apprentice within
Page 9, Line 4thirty days after notice of noncompliance pursuant to
Page 9, Line 5subsection (3.5)(c)(I) of this section, the board shall remove the

Page 9, Line 7apprentice shall not perform work as an electrical apprentice in the state.

Page 11, Line 1(b) (I) An apprentice who has been registered for at least six years
Page 11, Line 2and who does not meet the journeyman electrician license requirements
Page 11, Line 3specified in section 12-115-110 shall take the journeyman electrician
Page 11, Line 4license examination at least once every three years in alignment with the
Page 11, Line 5license renewal cycle until the apprentice receives a passing score. Once
Page 11, Line 6the apprentice passes the license examination, the apprentice must meet
Page 11, Line 7all other journeyman electrician license requirements specified in section
Page 11, Line 812-115-110 before the board may issue a journeyman electrician license to the apprentice.
Page 11, Line 9(II) An individual holding a residential wireman's license
Page 11, Line 10who registers with the department as an apprentice to perform
Page 11, Line 11commercial electrical work beyond the scope of the residential
Page 11, Line 12wireman's license is required to take the journeyman electrician license examination as required by this subsection (4)(b).

Page 11, Line 14apprentice are not reported as required by subsection (3)(c) of this section
Page 11, Line 15or if an apprentice fails to take the license examination as required by
Page 11, Line 16subsection (4) of this section, the board
may suspend shall declare thePage 11, Line 17apprentice's registration
until the requirements are met statusPage 11, Line 18"inactive" pursuant to subsections (5)(a)(II) and (5)(a)(III) of this section.
Page 11, Line 19(II) On and after July 1, 2026, the board shall produce and
Page 11, Line 20review a list of apprentices who are not in compliance at the end
Page 11, Line 21of each three-year license renewal period, notify each
Page 11, Line 22electrical contractor of any apprentices that are in
Page 11, Line 23noncompliance status, and provide notice that the apprentice
Page 12, Line 1has ninety calendar days after the date of receipt of the notice
Page 12, Line 2of noncompliance to meet the requirements of this section. The
Page 12, Line 3board may provide earlier or more frequent compliance updates to electrical contractors at the board's discretion.
Page 12, Line 4(III) The registration status of an apprentice who is not in
Page 12, Line 5compliance ninety calendar days after the date of receipt of the
Page 12, Line 6notice of noncompliance provided pursuant to subsection
Page 12, Line 7(5)(a)(II) of this section is declared "inactive". After the board
Page 12, Line 8determines that the apprentice is in compliance, their
Page 12, Line 9registration status is restored to active by the board, and the apprentice may resume work.
Page 12, Line 10(c) This section does not require an individual who has
Page 12, Line 11earned a master electrician's license to take the journeyman electrician license examination.
Page 12, Line 12(8) The board may sanction an electrical contractor that
Page 12, Line 13consistently and willfully demonstrates a lack of compliance
Page 12, Line 14with this section or whose apprentices show a significant pattern of noncompliance under this section.

Page 16, Line 13agency and the department shall establish data-sharing agreements and policies, including performing the following:
Page 16, Line 14(I) At least once per calendar quarter, the state
Page 16, Line 15apprenticeship agency shall provide a list of the approved
Page 16, Line 16registered plumbing apprenticeship programs that are
Page 16, Line 17registered with the state apprenticeship agency and a list of the
Page 16, Line 18plumbing apprentices registered in those programs who are
Page 16, Line 19eligible to register as plumbing apprentices with the board pursuant to subsection (3.5)(a) of this section.
Page 16, Line 20(II) At least once per calendar quarter, the board shall
Page 16, Line 21provide the state apprenticeship agency a list of the plumbing
Page 16, Line 22apprentices registered with the board. At a reasonable time
Page 16, Line 23after receipt of the list, the state apprenticeship agency shall
Page 17, Line 1provide the board with a list of plumbing apprentices registered
Page 17, Line 2with the board who are enrolled to be trained for occupations
Page 17, Line 3other than plumbing occupations and who are therefore
Page 17, Line 4ineligible for registration with the board pursuant to
Page 17, Line 5subsection (3.5)(a) of this section. The board shall review the
Page 17, Line 6list sent by the state apprenticeship agency to determine if the
Page 17, Line 7plumbing apprentices are in compliance with subsection (3.5)(a) of this section.
Page 17, Line 8(III) The board shall indicate for each plumbing
Page 17, Line 9apprentice registered with the board if the plumbing apprentice's registration is sponsored by:
Page 17, Line 10(A) A plumbing contractor;
Page 17, Line 11(B) A plumbing training program that is not an
Page 17, Line 12apprenticeship program registered with the United States
Page 17, Line 13department of labor or a state apprenticeship agency recognized by the United States department of labor; or
Page 17, Line 14(C) A plumbing apprenticeship program registered with the
Page 17, Line 15United States department of labor or a state apprenticeship agency.
Page 17, Line 16(c) (I) If the board determines that a plumbing apprentice
Page 17, Line 17is not in compliance with subsection (3.5)(a) of this section, the
Page 17, Line 18board shall notify the plumbing contractor or apprenticeship
Page 17, Line 19program that registered the apprentice with the board. Within
Page 17, Line 20thirty days after notification of noncompliance, the plumbing
Page 17, Line 21contractor or apprenticeship program shall provide proof that
Page 17, Line 22the apprentice is eligible to be registered as a plumbing
Page 17, Line 23apprentice with the board. If the board verifies within thirty
Page 18, Line 1days after notification of noncompliance that the plumbing
Page 18, Line 2apprentice is eligible to be registered as a plumbing apprentice, the plumbing apprentice will remain registered with the board.
Page 18, Line 3(II) If the board cannot verify that a plumbing apprentice
Page 18, Line 4is eligible to be registered as a plumbing apprentice within thirty
Page 18, Line 5days after notice of noncompliance pursuant to subsection
Page 18, Line 6(3.5)(c)(I) of this section, the board shall remove the plumbing
Page 18, Line 7apprentice's registration with the board, and the noncompliant
Page 18, Line 8plumbing apprentice shall not perform work as a plumbing apprentice in the state.
Page 18, Line 9(III) This subsection (3.5) does not apply to a plumbing
Page 18, Line 10apprentice whose registration is sponsored by a plumbing
Page 18, Line 11contractor or other plumbing training program that is not an
Page 18, Line 12apprenticeship program registered with the United States department of labor or a state apprenticeship agency.

(4) On and after July 1, 2021, contingent on the availability ofPage 18, Line 14
existing resources within the department or the receipt of gifts, grants, and donations pursuant to subsection (8) of this section:Page 18, Line 15(4) (a) (I) A plumbing apprentice who has been registered for at

Page 18, Line 19two years in alignment with the license renewal cycle until the plumbing
Page 18, Line 20apprentice receives a passing score. A registered plumbing
Page 18, Line 21contractor or an apprenticeship program registered with the
Page 18, Line 22United States department of labor or a state apprenticeship
Page 18, Line 23agency recognized by the United States department of labor
Page 19, Line 1may authorize, through written authorization provided to the
Page 19, Line 2board, an apprentice to take the residential plumber's license
Page 19, Line 3examination instead of the journeyworker license examination to satisfy the requirements of this subsection (4)(a)(I) if:
Page 19, Line 4(A) The plumbing contractor or apprenticeship program
Page 19, Line 5determines that the relevant practical experience of the
Page 19, Line 6apprentice is best suited to pursue the residential plumber's license instead of a journeyworker plumber's license; or
Page 19, Line 7(B) The plumbing contractor or apprenticeship program
Page 19, Line 8determines that the apprentice would be more likely to achieve a plumber's license by pursuing a residential plumber's license.
Page 19, Line 9(II) If a plumbing apprentice has failed to pass the license
Page 19, Line 10examination in two consecutive two-year periods, the plumbing
Page 19, Line 11apprentice may request an exemption from the board from future
Page 19, Line 12examination requirements. The board shall grant the exemption if:

board determines that the plumbing apprentice has legitimate educationalPage 19, Line 14
or professional circumstances that justify the exemption. The board shallPage 19, Line 15
promulgate rules concerning the process of requesting and approving license examination exemptions.Page 19, Line 16(A) The board determines that the plumbing apprentice
Page 19, Line 17has legitimate educational or professional circumstances that justify the exemption; or
Page 19, Line 18(B) The plumbing apprentice has passed the residential
Page 19, Line 19plumber's license examination and is only performing residential plumbing work.
Page 19, Line 20(III) The board shall adopt rules concerning the process
Page 19, Line 21of requesting and approving license examination exceptions and
Page 20, Line 1exemptions pursuant to subsections (4)(a)(I) and (4)(a)(II) of this section.
Page 20, Line 2(b) (I) A plumbing apprentice who has been registered for at least
Page 20, Line 3six years and who does not meet the license requirements specified in
Page 20, Line 4section 12-155-110
shall must take the license examination at least oncePage 20, Line 5every two years in alignment with the license renewal cycle until the
Page 20, Line 6plumbing apprentice receives a passing score. Once the plumbing
Page 20, Line 7apprentice passes the license examination, the apprentice must meet all
Page 20, Line 8other license requirements specified in section 12-155-110 before the board may issue a license to the plumbing apprentice.
Page 20, Line 9(II) An individual holding a residential plumber's license
Page 20, Line 10who registers with the department as a plumbing apprentice to
Page 20, Line 11perform commercial plumbing work beyond the scope of the
Page 20, Line 12residential plumber's license is required to take the
Page 20, Line 13journeyworker plumber's license examination as required by this subsection (4)(b).
Page 20, Line 14(5) (a) (I) If the cumulative training hours of a plumbing
Page 20, Line 15apprentice are not reported as required by subsection (3) of this section
Page 20, Line 16or if a plumbing apprentice fails to take the license examination as
Page 20, Line 17required by subsection (4) of this section, the board
may suspend shallPage 20, Line 18declare the plumbing apprentice's registration
until the requirements arePage 20, Line 19
met status "inactive" pursuant to subsections (5)(a)(II) and (5)(a)(III) of this section.Page 20, Line 20(II) On and after July 1, 2026, the board shall produce and
Page 20, Line 21review a list of plumbing apprentices who are not in compliance
Page 20, Line 22at the end of each three-year license renewal period, notify
Page 20, Line 23each registered plumbing contractor of any plumbing
Page 21, Line 1apprentices that are in noncompliance status, and provide notice
Page 21, Line 2that the plumbing apprentice has ninety calendar days after the
Page 21, Line 3date of receipt of the notice of noncompliance to meet the
Page 21, Line 4requirements of this section. The board may provide earlier or
Page 21, Line 5more frequent compliance updates to registered plumbing contractors at the board's discretion.
Page 21, Line 6(III) The registration status of a plumbing apprentice who
Page 21, Line 7is not in compliance ninety calendar days after the date of
Page 21, Line 8receipt of the notice of noncompliance provided pursuant to
Page 21, Line 9subsection (5)(a)(II) of this section is declared "inactive". After
Page 21, Line 10the board determines that the plumbing apprentice is in
Page 21, Line 11compliance, their registration status is restored to active by the board, and the apprentice may resume work.
Page 21, Line 12(c) This section does not require an individual who has
Page 21, Line 13earned a master plumber's license to take the journeyworker plumber's license examination.
Page 21, Line 14(9) The board may sanction a registered plumbing
Page 21, Line 15contractor that consistently and willfully demonstrates a
Page 21, Line 16lack of compliance with this section or whose plumbing
Page 21, Line 17apprentices show a significant pattern of noncompliance under this section.
Page 21, Line 18SECTION 4. Act subject to petition - effective date. This act
Page 21, Line 19takes effect at 12:01 a.m. on the day following the expiration of the
Page 21, Line 20ninety-day period after final adjournment of the general assembly; except
Page 21, Line 21that, if a referendum petition is filed pursuant to section 1 (3) of article V
Page 21, Line 22of the state constitution against this act or an item, section, or part of this
Page 21, Line 23act within such period, then the act, item, section, or part will not take
Page 22, Line 1effect unless approved by the people at the general election to be held in
Page 22, Line 2November 2026 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
