Page 1, Line 6(1) As used in this section, unless the context otherwise
Page 1, Line 7requires:
Page 1, Line 8(a) "Facilitator" means the neutral facilitator that the
Page 1, Line 9department contracts with pursuant to subsection (3) of this
Page 1, Line 10section.
Page 1, Line 11(b) "Working group" means the transportation funding
Page 1, Line 12working group created in subsection (2) of this section.
Page 1, Line 13(2) There is created in the department the transportation
Page 1, Line 14funding working group. The working group shall meet as
Page 1, Line 15necessary to evaluate and make recommendations concerning
Page 1, Line 16funding state and local surface transportation maintenance,
Page 1, Line 17repair, capacity, and safety.
Page 1, Line 18(3) The department shall contract with a neutral
Page 1, Line 19facilitator to organize and manage the working group's
Page 1, Line 20meetings, guide the working group's deliberations, and draft the
Page 1, Line 21reports required pursuant to subsections (7)(a) and (7)(b) of this
Page 1, Line 22section.
Page 1, Line 23(4) (a) The working group consists of the following
Page 1, Line 24members:
Page 1, Line 25(I) The executive director or the executive director's
Page 1, Line 26designee;
Page 1, Line 27(II) One member appointed by the governor with expertise
Page 2, Line 1in public finance;
Page 2, Line 2(III) One member appointed by the governor to represent
Page 2, Line 3environmental conservation or environmental justice groups;
Page 2, Line 4(IV) One member appointed by the speaker of the house of
Page 2, Line 5representatives to represent counties across the state;
Page 2, Line 6(V) One member appointed by the speaker of the house of
Page 2, Line 7representatives to represent licensed professional engineers;
Page 2, Line 8(VI) One member appointed by the minority leader of the
Page 2, Line 9house of representatives to represent an association of motor
Page 2, Line 10carriers;
Page 2, Line 11(VII) One member appointed by the president of the senate
Page 2, Line 12to represent municipalities across the state;
Page 2, Line 13(VIII) One member appointed by the president of the senate
Page 2, Line 14to represent economic development organizations; and
Page 2, Line 15(IX) One member appointed by the minority leader of the
Page 2, Line 16senate to represent construction contractor professionals.
Page 2, Line 17(b) The applicable appointing authorities shall make all
Page 2, Line 18of the appointments described in subsection (4)(a) of this section
Page 2, Line 19no later June 19, 2026.
Page 2, Line 20(c) Members of the working group serve at the pleasure of
Page 2, Line 21the applicable appointing authority. If a vacancy occurs, the
Page 2, Line 22appropriate appointing authority shall appoint a replacement
Page 2, Line 23member who meets the requirements set forth in subsection (4)(a)
Page 2, Line 24of this section for the vacant position not later than one week
Page 2, Line 25from the date the vacancy exists. If the appropriate appointing
Page 2, Line 26authority fails to appoint a replacement member as required by
Page 2, Line 27this subsection (4)(c), the governor shall appoint a replacement
Page 2, Line 28member who meets the requirements set forth in subsection (4)(a)
Page 2, Line 29of this section.
Page 2, Line 30(d) Members of the working group serve without
Page 2, Line 31compensation and without reimbursement for expenses.
Page 2, Line 32(e) Members of the working group may participate
Page 2, Line 33remotely in working group meetings.
Page 2, Line 34(5) (a) The facilitator shall convene the first meeting of
Page 2, Line 35the working group during the week of June 29, 2026. The working
Page 2, Line 36group shall adopt bylaws at the first working group meeting.
Page 2, Line 37(b) The working group shall meet at least once every two
Page 2, Line 38weeks beginning the week of June 29, 2026, through the week of
Page 2, Line 39November 2, 2026. The working group may meet more often at the
Page 2, Line 40discretion of the facilitator. A majority of the members of the
Page 2, Line 41working group may vote to extend the work of the commission
Page 2, Line 42past the week of November 2, 2026, or to terminate the working
Page 2, Line 43group's work at any time.
Page 3, Line 1(c) The working group may meet with subject matter
Page 3, Line 2experts as needed, such as experts on the state budget, public
Page 3, Line 3financing, and transportation construction.
Page 3, Line 4(6) The working group's purpose is to identify approaches
Page 3, Line 5to augment state and local funding for surface transportation
Page 3, Line 6maintenance, repair, capacity, and safety by increasing revenue,
Page 3, Line 7while focusing on increasing revenue that is protected for such
Page 3, Line 8purposes, is sustainable, and does not necessitate cuts to core
Page 3, Line 9state and local services.
Page 3, Line 10(7) (a) No later than September 7, 2026, the working group
Page 3, Line 11shall submit a preliminary status report to the transportation,
Page 3, Line 12housing, and local government committee of the house of
Page 3, Line 13representatives, the transportation and energy committee of
Page 3, Line 14the senate, the transportation commission created in section
Page 3, Line 1543-1-106, and the governor. The report must include:
Page 3, Line 16(I) A summary of the working group's discussions and
Page 3, Line 17findings; and
Page 3, Line 18(II) The potential state budgetary impacts, as discussed by
Page 3, Line 19the working group, of potential approaches to augment state
Page 3, Line 20and local funding for surface transportation maintenance,
Page 3, Line 21repair, capacity, and safety needs.
Page 3, Line 22(b) No later than November 13, 2026, the working group
Page 3, Line 23shall submit a report to the transportation, housing, and local
Page 3, Line 24government committee of the house of representatives, the
Page 3, Line 25transportation and energy committee of the senate, the
Page 3, Line 26transportation commission created in section 43-1-106, and the
Page 3, Line 27governor. The report must include the working group's findings
Page 3, Line 28and recommendations to the general assembly concerning
Page 3, Line 29matters evaluated by the working group.
Page 3, Line 30(8) (a) The department shall be available to assist the
Page 3, Line 31working group in carrying out the working group's duties. The
Page 3, Line 32department may adopt internal procedures to ensure that the
Page 3, Line 33working group's work is conducted in an orderly, timely, and
Page 3, Line 34goal-oriented manner.
Page 3, Line 35(b) Notwithstanding any law to the contrary, the
Page 3, Line 36department may expend money from the state highway fund,
Page 3, Line 37created in section 43-1-219, for the working group's purposes
Page 3, Line 38including for hiring professional facilitation services, assisting
Page 3, Line 39the working group pursuant to subsection (8)(a) of this section,
Page 3, Line 40and other necessary services.
Page 3, Line 41(9) This section is repealed, effective July 1, 2027.".

Page 4, Line 141-40-134, from the statewide ballot for the general election held on
Page 4, Line 15November 3, 2026, in which case section 12 of this act takes effect on
Page 4, Line 16June 16, 2026.".
