Bill Summary

The bill requires a child care center to disclose the following information in its policies and procedures to the parents or guardians of children being served at the child care center:
- A statement that child care center workers are mandatory reporters of child abuse or neglect under state law; and
- For a child care center that utilizes video recording equipment, a written disclosure of the presence of video recording equipment and the child care center's policies and procedures regarding the use of the video recording equipment and the generated video footage.

Page 2, Line 12section 19-3-304 (2)(m); and
Page 2, Line 13(b) For a child care center that utilizes video recording
Page 2, Line 14equipment, a statement disclosing the use of video recording
Page 2, Line 15equipment and the child care center's policies and procedures
Page 2, Line 16regarding the use of the video recording equipment and the
Page 2, Line 17generated video footage, including, when applicable, the
Page 2, Line 18center's recording, retention, and disposal policy; privacy
Page 2, Line 19protections and limitations; parental and legal access to the
Page 2, Line 20video footage; and any other policies or procedures the child
Page 2, Line 21care center develops in relation to the use of the video
Page 2, Line 22recording equipment and the generated video footage.
Page 2, Line 23SECTION 2. Act subject to petition - effective date. This act
Page 3, Line 1takes effect at 12:01 a.m. on the day following the expiration of the
Page 3, Line 2ninety-day period after final adjournment of the general assembly (August
Page 3, Line 312, 2026, if adjournment sine die is on May 13, 2026); except that, if a
Page 3, Line 4referendum petition is filed pursuant to section 1 (3) of article V of the
Page 3, Line 5state constitution against this act or an item, section, or part of this act
Page 3, Line 6within such period, then the act, item, section, or part will not take effect
Page 3, Line 7unless approved by the people at the general election to be held in
Page 3, Line 8November 2026 and, in such case, will take effect on the date of the
Page 3, Line 9official declaration of the vote thereon by the governor.
