Bill Summary

Committee on Legal Services. Based on the findings and recommendations of the committee on legal services, the bill extends all state agency rules that were adopted or amended on or after November 1, 2023, and before November 1, 2024, with the exception of certain rules of the state board of education and the division of fire prevention and control in the department of public safety, as specified in the bill.
The specified rules will expire as scheduled in the "State Administrative Procedure Act" on May 15, 2025, on the grounds that the rules conflict with statute.

Page 2, Line 315, 2025 - exceptions. (1) Except as indicated, the expiration of all rules
Page 2, Line 4of agencies in the following principal departments, which rules were
Page 2, Line 5adopted or amended on or after November 1, 2023, and before November
Page 2, Line 61, 2024, and that are therefore scheduled for expiration May 15, 2025, is postponed:
Page 2, Line 7(a) Department of agriculture;
(b) Department of corrections;
Page 2, Line 8(c) Department of early childhood;
Page 2, Line 9(d) Department of education; except that the following rules of the
Page 2, Line 10state board of education concerning rules for the administration of the public school finance act of 1994 (1 CCR 301-39) are not extended:
Page 2, Line 11(I) Rule 3.04, which states in part "The applicable 11-day count period is defined as ...";
Page 2, Line 12(II) Rule 5.04, which states in part "Pupils that first establish
Page 2, Line 13attendance after the applicable count date but within the applicable 11-day count period ... for funding at the sending district"; and
Page 2, Line 14(III) Rule 5.12(6), which states in part "If a pupil transfers from
Page 2, Line 15one Colorado public school district to another, after the pupil enrollment count date but within the 11-day count period ...";
Page 2, Line 16(e) Department of health care policy and financing;
Page 2, Line 17(f) Department of higher education;
(g) Department of human services;
Page 3, Line 1(h) Department of labor and employment; except that the

(l) Department of natural resources;
Page 3, Line 7(m) Department of personnel;
(n) Department of public health and environment;
Page 3, Line 8(o) Department of public safety; except that the following rule of

Page 3, Line 10wildfire resilient homes grant program (8 CCR 1507-37) is not extended:
Page 3, Line 11Rule 2.1's definition of "homeowner", which states in part "'Homeowner' means a person who owns property ... wildfires";
Page 3, Line 12(p) Department of regulatory agencies; except that the following
Page 3, Line 13rule of the state board of nursing concerning nursing rules and regulations
Page 3, Line 14(3 CCR 716-1) is not extended: Rule 1.28 K. 1., which states in part "A Certified Midwife scope of practice is set ...";

(r) Department of state;
Page 3, Line 16(s) Department of transportation; and
(t) Department of the treasury.
Page 3, Line 17(2) The expiration of all rules of the public employees' retirement
Page 3, Line 18association, which rules were adopted or amended on or after November
Page 4, Line 11, 2023, and before November 1, 2024, and which are therefore scheduled for expiration May 15, 2025, is postponed.
Page 4, Line 2(3) The expiration of all rules of the board of equalization, which
Page 4, Line 3rules were adopted or amended on or after November 1, 2023, and before
Page 4, Line 4November 1, 2024, and which are therefore scheduled for expiration May 15, 2025, is postponed.
Page 4, Line 5(4) The recommendations of the committee on legal services as
Page 4, Line 6reflected in this act apply to the specified rules in the form in which the
Page 4, Line 7rules were considered and acted upon by the committee. Any amendments
Page 4, Line 8or other changes in the specified rules that became effective before
Page 4, Line 9November 1, 2024, that comply with the recommendations of the
Page 4, Line 10committee on legal services are not affected by this act. Any subsequent
Page 4, Line 11amendments or other changes in the specified rules that became effective on or after November 1, 2024, are not affected by this act.
Page 4, Line 12SECTION 2. Safety clause. The general assembly finds,
Page 4, Line 13determines, and declares that this act is necessary for the immediate
Page 4, Line 14preservation of the public peace, health, or safety or for appropriations for
Page 4, Line 15the support and maintenance of the departments of the state and state institutions.
