The bill exempts quantum computing devices and quantum sensing devices from the "Consumer Repair Bill of Rights Act".
Page 1, Line 1Be it enacted by the General Assembly of the State of Colorado:
Page 2, Line 1SECTION 1. Short title. The short title of this act is the "Entanglement Exception Act".
Page 2, Line 2SECTION 2. In Colorado Revised Statutes, 6-1-1503, add (5)(o) and (5)(p) as follows:
Page 2, Line 36-1-1503. Manufacturer obligations regarding services -
Page 2, Line 4exemptions. (5) With respect to digital electronic equipment, this part 15 does not apply to:
Page 2, Line 5(o) Devices, components, or systems designed to perform
Page 2, Line 6or facilitate quantum information processing, including, solely
Page 2, Line 7to the extent necessary for such processing, storing, computing,
Page 2, Line 8communicating, measuring, or sensing quantum information,
Page 2, Line 9through manipulation, measurement, sensing, or utilization of
Page 2, Line 10quantum phenomena, limited to instances where the phenomena
Page 2, Line 11are integral to the device's primary function, including quantum
Page 2, Line 12superposition, quantum entanglement, quantum interference, quantum tunneling, or quantum transduction; or
Page 2, Line 13(p) Quantum sensing devices that exploit quantum
Page 2, Line 14phenomena, limited to instances where the phenomena are
Page 2, Line 15integral to the device's primary function, such as quantum
Page 2, Line 16coherence, quantum entanglement, quantized energy states
Page 2, Line 17that do not include the semiconductor band gap phenomenon,
Page 2, Line 18quantum squeezing, quantum superposition, quantum
Page 2, Line 19interference, quantum transduction, or quantum tunneling, to
Page 2, Line 20detect, measure, or monitor physical quantities, environmental parameters, or external stimuli.
Page 2, Line 21SECTION 3. Act subject to petition - effective date. This act
Page 2, Line 22takes effect January 1, 2026; except that, if a referendum petition is filed
Page 3, Line 1pursuant to section 1 (3) of article V of the state constitution against this
Page 3, Line 2act or an item, section, or part of this act within the ninety-day period
Page 3, Line 3after final adjournment of the general assembly, then the act, item,
Page 3, Line 4section, or part will not take effect unless approved by the people at the
Page 3, Line 5general election to be held in November 2026 and, in such case, will take
Page 3, Line 6effect on the date of the official declaration of the vote thereon by the governor.
