After consideration on the merits, the Committee recommends the following:
HB26-1325 be amended as follows, and as so amended, be referred to the Committee of the Whole with favorable recommendation:
Page 1, Line 1Amend printed bill, page 3, line 23, strike "definitions." and substitute
Page 1, Line 2"definitions - repeal.".
Page 1, Line 3Page 8, after line 25 insert:
Page 1, Line 4"(15) The BHA shall work to secure federal research and
Page 1, Line 5development funding available through the advanced research
Page 1, Line 6projects agency for health within the federal department of
Page 1, Line 7health and human services, or other available federal funding,
Page 1, Line 8in order to advance research efforts on the use of ibogaine as a
Page 1, Line 9treatment for serious mental illnesses.
Page 1, Line 10(16) Subsections (1), (2), (3), (4), (5), (6), (7), (8), (11), (12),
Page 1, Line 11(13), (14), and (15) of this section take effect if the BHA receives
Page 1, Line 12one hundred fifty thousand dollars in gifts, grants, or
Page 1, Line 13donations, or if the BHA receives in-kind donations for which
Page 1, Line 14the value is equal to one hundred fifty thousand dollars,
Page 1, Line 15before January 1, 2028, for the purpose of implementing this
Page 1, Line 16section. The commissioner of the BHA shall notify the revisor of
Page 1, Line 17statutes in writing of the date on which the condition specified
Page 1, Line 18in this subsection (16) has occurred by emailing the notice to
Page 1, Line 19[email protected]. Subsections (1), (2), (3), (4), (5),
Page 1, Line 20(6), (7), (8), (11), (12), (13), (14), and (15) of this section take effect
Page 1, Line 21on the date identified in the notice to the revisor of statutes
Page 1, Line 22that the BHA has received one hundred fifty thousand dollars
Page 1, Line 23in gifts, grants, or donations, or an in-kind donation for which
Page 1, Line 24the value is equal to one hundred fifty thousand dollars, for
Page 1, Line 25the purpose of this section, or, if the notice to the revisor of

Page 2, Line 25dollars, or additional gifts, grants, or donations in the amount
Page 2, Line 26necessary to cover the total remaining cost of the pilot
Page 2, Line 27program are not received within three hundred sixty-five days
Page 2, Line 28following the date on which the revisor of statutes receives
Page 2, Line 29notice pursuant to subsection (17) of this section, the state
Page 2, Line 30treasurer shall return from the fund to the grantor or donor
Page 2, Line 31the amount of the grantor's or donor's gifts, grants, or
Page 2, Line 32donations and, notwithstanding subsection (17) of this section,
Page 2, Line 33the BHA shall not accept additional gifts, grants, or donations
Page 2, Line 34for the purposes of this section.
Page 2, Line 35(b) If any money remains in the fund after the state
Page 2, Line 36treasurer returns money to donors or grantors pursuant to
Page 2, Line 37subsection (18)(a) of this section, as applicable, the state
Page 2, Line 38treasurer shall, prior to the repeal of the fund, transfer all
Page 2, Line 39unexpended and unencumbered money in the fund to the
Page 2, Line 40regulated natural medicine cash fund created in section
Page 2, Line 4144-50-601.".
