Current law prohibits a person licensed to sell alcohol beverages at the retail level (licensee) from selling, serving, or distributing malt, vinous, or spirituous liquors between 2 a.m. and 7 a.m. The bill allows a licensee to allow customers to consume malt, vinous, or spirituous liquors from 2 a.m. to 3 a.m. on the licensed premises if the licensee:
- Stops selling malt, vinous, or spiritous liquors and closes out all open charges no later than 2:30 a.m.; and
- Removes all purchased malt, vinous, or spirituous liquors from the consumption area of the licensed premises no later than 3 a.m.
The bill only applies to a licensee if the county, city and county, or municipality that the licensee is operating within adopts a law opting into the application of the bill to their jurisdiction. The local law may be more strict than the bill.

Page 2, Line 2SECTION 1. In Colorado Revised Statutes, 44-3-901, amend (6)(b)(I); and add (6.5) as follows:
Page 2, Line 344-3-901. Unlawful acts - exceptions - definitions. (6) It is
Page 2, Line 4unlawful for any person licensed to sell at retail pursuant to this article 3 or article 4 of this title 44:
Page 2, Line 5(b) To sell, serve, or distribute any malt, vinous, or spirituous liquors at any time other than the following:
Page 2, Line 6(I) Except as set forth in subsection (6.5) of this section,
Page 2, Line 7for consumption on the premises on any day of the week, except between the hours of 2 a.m. and 7 a.m.;
Page 2, Line 8(6.5) (a) Subject to subsection (6.5)(b) of this section, a
Page 2, Line 9licensee may allow customers to consume malt, vinous, or
Page 2, Line 10spirituous liquors from 2 a.m. to 3 a.m. on the licensed premises if the licensee:
Page 2, Line 11(I) Stops selling malt, vinous, or spirituous liquors and closes all open charges no later than 2:30 a.m.; and
Page 2, Line 12(II) Removes all purchased malt, vinous, or spirituous
Page 2, Line 13liquors from the consumption area of the licensed premises no
Page 2, Line 14later than 3 a.m.
Page 3, Line 1(b) Subsection (6.5)(a) of this section only applies to a
Page 3, Line 2licensee if the governing body of the county, city and county, or
Page 3, Line 3municipality that the licensee is operating within adopts an
Page 3, Line 4ordinance, resolution, regulation, or other law opting into the
Page 3, Line 5application of subsection (6.5)(a) of this section to their
Page 3, Line 6jurisdiction. A governing body of a county, city and county, or
Page 3, Line 7municipality may adopt an ordinance, resolution, regulation, or
Page 3, Line 8other law that is more strict than subsection (6.5)(a) of this section.
Page 3, Line 9SECTION 2. Act subject to petition - effective date. This act
Page 3, Line 10takes effect at 12:01 a.m. on the day following the expiration of the
Page 3, Line 11ninety-day period after final adjournment of the general assembly; except
Page 3, Line 12that, if a referendum petition is filed pursuant to section 1 (3) of article V
Page 3, Line 13of the state constitution against this act or an item, section, or part of this
Page 3, Line 14act within such period, then the act, item, section, or part will not take
Page 3, Line 15effect unless approved by the people at the general election to be held in
Page 3, Line 16November 2026 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
