Sunset Process - Senate Transportation and Energy Committee. The bill implements the recommendations of the department of regulatory agencies (department) regarding the motorcycle operator training program (MOST program), as contained in the department's sunset review of the MOST program, as follows:
- Continues the MOST program in the office of the chief of the state patrol in the department of public safety for 9 years, until September 1, 2034 (sections 1 and 2 of the bill);
- Lowers the required minimum age to be a MOST instructor from 21 to 18 years of age (section 3);
- Removes the authority of the motorcycle operator safety advisory board to make recommendations on expenditures of money from the MOST fund (section 4); and
- Makes a technical change to align with the placement of the MOST program within the Colorado state patrol rather than the department of transportation (section 5).

Page 4, Line 6two years, the historical data for eligible students and eligible courses over the previous two years; or
Page 4, Line 7(III) For a MOST vendor that has been certified for two
Page 4, Line 8years or less, the available historical data for eligible
Page 4, Line 9students and eligible courses or an estimate of the eligible students and eligible courses.
Page 4, Line 10(d) As used in this subsection (4), unless the context otherwise requires:
Page 4, Line 11(I) "Eligible course" means a certified motorcycle
Page 4, Line 12operator safety training course that meets all requirements established by rule.
Page 4, Line 13(II) "Eligible student" means an individual who is eligible
Page 4, Line 14to enroll in an eligible course and who meets all other requirements established by rule.
Page 4, Line 15(e) The chief may adopt rules as necessary for the implementation of this subsection (4).
Page 4, Line 16SECTION 6. Act subject to petition - effective date. This act
Page 4, Line 17takes effect at 12:01 a.m. on the day following the expiration of the
Page 4, Line 18ninety-day period after final adjournment of the general assembly; except
Page 4, Line 19that, if a referendum petition is filed pursuant to section 1 (3) of article V
Page 5, Line 1of the state constitution against this act or an item, section, or part of this
Page 5, Line 2act within such period, then the act, item, section, or part will not take
Page 5, Line 3effect unless approved by the people at the general election to be held in
Page 5, Line 4November 2026 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
