The capitol building advisory committee (advisory committee) is currently required to evaluate and make recommendations to the capital development committee and, in some cases, the governor regarding proposals for the gift or loan of art and memorials to be placed on a permanent or temporary basis in the capitol building or on its surrounding grounds. The bill adds the public areas of the capitol building annex and its surrounding grounds and the public areas of the legislative services building and its surrounding grounds to the advisory committee's purview in connection with proposals for the gift or loan of art and memorials.
In addition, current law specifies that the art, memorials, architectural fixtures, and furniture that are original to the capitol building must remain in the capitol building at all times unless the items are temporarily removed for conservation. The bill allows the removal of items original to the capitol building for loan, exhibit, research, or disposition with the approval of the advisory committee.

Page 2, Line 2SECTION 1. In Colorado Revised Statutes, 24-82-108, amend (3)(h)(I), (3)(h)(III), and (3.5)(c) as follows:

Page 2, Line 4creation - duties - legislative declaration - repeal. (3) Duties of the
Page 2, Line 5advisory committee. The advisory committee has the duties specified in subsections (3)(a) through (3)(i) of this section.
Page 2, Line 6(h) Proposals for a gift or loan of art and memorials. (I) Except
Page 2, Line 7as provided in subsection (3)(h)(II) of this section, all proposals involving
Page 2, Line 8the gift or loan of objects of art and memorials to be placed on a
Page 2, Line 9permanent or temporary basis in the state capitol building or on its
Page 2, Line 10surrounding grounds, in the public areas of the capitol building
Page 2, Line 11annex or on its surrounding grounds, or in the public areas of
Page 2, Line 12the legislative services building or on its surrounding grounds,
Page 2, Line 13and proposals for fund-raising efforts to place objects of art or memorials
Page 2, Line 14in the state capitol building or on its surrounding grounds, in the public
Page 2, Line 15areas of the capitol building annex or on its surrounding
Page 2, Line 16grounds, or in the public areas of the legislative services
Page 2, Line 17building or on its surrounding grounds shall be submitted to the
Page 2, Line 18advisory committee for evaluation. The advisory committee shall develop
Page 3, Line 1criteria and a procedure for such evaluations, which shall include
Page 3, Line 2consulting with knowledgeable advisors to assist in evaluating each
Page 3, Line 3object of art or memorial individually. The advisory committee shall
Page 3, Line 4evaluate all proposals submitted to the advisory committee and present recommendations resulting from the evaluations as follows:
Page 3, Line 5(A) Proposals involving the gift or loan of objects of art and
Page 3, Line 6memorials pertaining to all public areas of the state capitol building,
Page 3, Line 7including but not limited to the corridors, rotunda, lobbies, entrance ways,
Page 3, Line 8stairways, restrooms, porticos, steps, and elevators, all public areas of
Page 3, Line 9the capitol building annex, and all public areas of the
Page 3, Line 10legislative services building must be submitted to the capital
Page 3, Line 11development committee for approval. No such proposal shall proceed without the prior approval of the capital development committee.
Page 3, Line 12(B) Proposals involving the gift or loan of objects of art and
Page 3, Line 13memorials pertaining to the surrounding grounds of the capitol building
Page 3, Line 14bounded by Colfax avenue on the north, Grant street on the east,
Page 3, Line 15Fourteenth avenue on the south, and Broadway on the west, in the city
Page 3, Line 16and county of Denver, must be submitted to the capital development
Page 3, Line 17committee and the governor for approval. In addition, proposals
Page 3, Line 18involving the gift or loan of objects of art and memorials
Page 3, Line 19pertaining to the surrounding grounds of the capitol building
Page 3, Line 20annex or the surrounding grounds of the legislative services
Page 3, Line 21building must be submitted to the capital development
Page 3, Line 22committee and the governor for approval. No such proposal shall
Page 3, Line 23proceed without the prior approval of the capital development committee and the governor.
Page 3, Line 24(III) The advisory committee is authorized to direct the removal
Page 4, Line 1of any objects of art or memorials that are placed in the state capitol
Page 4, Line 2building or on its surrounding grounds, in the public areas of the
Page 4, Line 3capitol building annex or on its surrounding grounds, or in the
Page 4, Line 4public areas of the legislative services building or on its
Page 4, Line 5surrounding grounds that have not been submitted to the advisory
Page 4, Line 6committee for evaluation and approval pursuant to the criteria and
Page 4, Line 7procedure developed by the advisory committee pursuant to subsection
Page 4, Line 8(3)(h)(I) of this section. This subsection (3)(h)(III) does not apply to
Page 4, Line 9objects of art or memorials placed prior to the formation of the advisory committee.
Page 4, Line 10(3.5) Items original to the state capitol building. (c) The art,
Page 4, Line 11memorials, architectural fixtures, and furniture that

it is they are part of thePage 4, Line 13Colorado collection pursuant to subsection (3)(d) of this section, must

temporarily removed from thePage 4, Line 16capitol building for conservation, loan, exhibit, research, or
Page 4, Line 17disposition from time to time with the approval of the advisory committee.
Page 4, Line 18SECTION 2. Act subject to petition - effective date. This act
Page 4, Line 19takes effect at 12:01 a.m. on the day following the expiration of the
Page 4, Line 20ninety-day period after final adjournment of the general assembly; except
Page 4, Line 21that, if a referendum petition is filed pursuant to section 1 (3) of article V
Page 4, Line 22of the state constitution against this act or an item, section, or part of this
Page 4, Line 23act within such period, then the act, item, section, or part will not take
Page 4, Line 24effect unless approved by the people at the general election to be held in
Page 5, Line 1November 2026 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
