After consideration on the merits, the Committee recommends the following:
HB26-1115 be amended as follows, and as so amended, be referred to the Committee of the Whole with favorable recommendation and with a recommendation that it be placed on the consent calendar:
Page 1, Line 1Amend reengrossed bill, page 8, line 15, strike "add" and substitute
Page 1, Line 2"amend (10); and add (9.7), (9.9), and".
Page 1, Line 3Page 8, after line 19 insert:
Page 1, Line 4"(9.7) "Provider" means a person that provides prepaid
Page 1, Line 5wireless telecommunications service.
Page 1, Line 6(9.9) "Purchase" means exchanges of money and exchanges

Page 2, Line 1registration and payment procedures that substantially coincide with the
Page 2, Line 2registration and payment procedures that apply under part 1 of article 26
Page 2, Line 3of title 39. A seller or provider is subject to the penalties under part 1
Page 2, Line 4of article 26 of title 39 for failure to collect or remit a prepaid wireless
Page 2, Line 5988 charge in accordance with this section.
Page 2, Line 6(b) A seller or provider that uses federally supported
Page 2, Line 7services or programs may deduct and retain three and three-tenths
Page 2, Line 8percent of the prepaid wireless 988 charges that are collected by the seller
Page 2, Line 9or provider from the consumers.".
