Concerning extending the Emily Keyes - John W. Buckner organ and tissue donation awareness fund indefinitely.

Be it enacted by the General Assembly of the State of Colorado:

SECTION 1.  Legislative declaration. (1)  The general assembly finds and declares that:

(a)  The Emily Keyes - John W. Buckner organ and tissue donation awareness fund ("fund") has helped to drive more than 15 million donor registrations in Colorado since its inception in 2007;

(b)  Since 2010, the fund has provided transplantation science educational course training for 122,436 Colorado students in 4,847 classrooms;

(c)  Over the last decade, the fund has printed and distributed over 10 million educational materials at 1,844 community events;

(d)  9,369 life-saving transplants were made possible by heroic donors in Colorado's service area since the fund's inception in 2007, and the number of transplants completed has been rising every year for the past 12 years; and

(e)  Donor Alliance, the federally designated nonprofit organ procurement organization in Colorado, has successfully operated as a fiduciary agent of the Emily Keyes - John W. Buckner organ and tissue donation awareness fund since 2010, and Donor Alliance has provided and will continue to provide all in-kind administrative support for the fund. Donor Alliance supplements the initiatives of the fund with more than the total amount the fund earns each year.

SECTION 2.  In Colorado Revised Statutes, 42-2-107, repeal (4)(b)(VIII) as follows:

42-2-107.  Application for license or instruction permit - anatomical gifts - donations to Emily Keyes - John W. Buckner organ and tissue donation awareness fund - legislative declaration - rules - annual report. (4) (b) (VIII)  This subsection (4)(b) is repealed, effective September 1, 2027.

SECTION 3.  In Colorado Revised Statutes, 42-2-118, repeal (1)(a)(II)(B) as follows:

42-2-118.  Renewal of license in person, by mail, or electronically - donations to Emily Keyes - John W. Buckner organ and tissue donation awareness fund - rules - report. (1) (a) (II) (B)  This subsection (1)(a)(II) is repealed, effective September 1, 2027.

SECTION 4.  Safety clause. The general assembly finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, or safety or for appropriations for the support and maintenance of the departments of the state and state institutions.
