Currently, a member of the Colorado state patrol must be bonded by a surety company or must be insured with third-party crime insurance. The bill creates an exception to the bonding or third-party insurance requirement if the Colorado state patrol is self-insured with the Colorado state office of risk management and is eligible to be compensated from the state self-insured property fund.

Page 2, Line 2SECTION 1. In Colorado Revised Statutes, 24-33.5-208, amend (1) introductory portion; and add (2) as follows:
Page 2, Line 324-33.5-208. Bonds - exception. (1) Except as provided in
Page 2, Line 4subsection (2) of this section, the members of the Colorado state
Page 2, Line 5patrol shall be required to give bond to the state in the amount indicated
Page 2, Line 6in this section, to be approved and paid for by the state. The bonds shall
Page 2, Line 7be issued by a surety company authorized to do business in the state in the following amounts:
Page 2, Line 8(2) A member of the Colorado state patrol is not required
Page 2, Line 9to give the bond otherwise required by subsection (1) of this
Page 2, Line 10section if the Colorado state patrol is self-insured through the
Page 2, Line 11Colorado state office of risk management and is eligible to be compensated pursuant to section 24-30-1510.5 (5)(g).

Page 2, Line 13takes effect at 12:01 a.m. on the day following the expiration of the
Page 2, Line 14ninety-day period after final adjournment of the general assembly; except
Page 2, Line 15that, if a referendum petition is filed pursuant to section 1 (3) of article V
Page 2, Line 16of the state constitution against this act or an item, section, or part of this
Page 2, Line 17act within such period, then the act, item, section, or part will not take
Page 2, Line 18effect unless approved by the people at the general election to be held in
Page 2, Line 19November 2026 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
