Page 1, Line 11(b) "Policy" means the policy adopted and implemented
Page 1, Line 12pursuant to subsection (2) of this section.
Page 1, Line 13(c) "Youth service organization" means a youth-serving
Page 1, Line 14nonprofit organization that:
Page 1, Line 15(I) Promotes civic education and engagement, positive
Page 1, Line 16youth development, leadership training and opportunities,
Page 1, Line 17social-emotional well-being, career and job readiness skills,
Page 1, Line 18mentorship opportunities, or community service opportunities to
Page 1, Line 19all youth;
Page 1, Line 20(II) Does not discriminate on the basis of disability, race,
Page 1, Line 21creed, color, national origin, ancestry, gender, or sex, except as
Page 1, Line 22described in Public Law 93-568, as enacted on December 31, 1974;
Page 1, Line 23(III) Offers extracurricular or enrichment activities that
Page 1, Line 24are reasonably available in proximity to the students of the
Page 1, Line 25local education provider with whom the youth services
Page 1, Line 26organization seeks to communicate pursuant to the policy
Page 2, Line 1adopted by the local education provider; and
Page 2, Line 2(IV) Has established and maintained a presence in the
Page 2, Line 3community of the students of the local education provider.
Page 2, Line 4(2) (a) On or before January 1, 2026, each local education
Page 2, Line 5provider shall adopt and implement a written policy, or update
Page 2, Line 6an existing policy if applicable, concerning options for youth
Page 2, Line 7services organizations to communicate with students about the
Page 2, Line 8opportunities available for extracurricular programs and
Page 2, Line 9enrichment activities through the youth service organization.
Page 2, Line 10(b) A youth service organization shall not communicate
Page 2, Line 11with students during instructional time.
Page 2, Line 12(c) In developing the policy, the local education provider
Page 2, Line 13may consider:
Page 2, Line 14(I) Prohibitions and exceptions for communication
Page 2, Line 15permitted by the policy that are specific to elementary school
Page 2, Line 16students, middle school students, and high school students that
Page 2, Line 17are appropriate based on the ages and developmental maturity
Page 2, Line 18of students who attend each type of school and any age
Page 2, Line 19restrictions for extracurricular or enrichment activities made
Page 2, Line 20available by the youth services organization;
Page 2, Line 21(II) Unintended burdens, including additional costs
Page 2, Line 22associated with the policy;
Page 2, Line 23(III) Any available evidence-based resources and
Page 2, Line 24research concerning outcomes of the extracurricular or
Page 2, Line 25enrichment activities made available by the youth service
Page 2, Line 26organization; and
Page 2, Line 27(IV) Methods of communication by a youth services
Page 2, Line 28organization that ensures students learn of opportunities for
Page 2, Line 29extracurricular or enrichment activities offered by a youth
Page 2, Line 30service organization in a manner that is likely to generate
Page 2, Line 31student interest in extracurricular opportunities or enrichment
Page 2, Line 32activities in general and specific to a youth service organization
Page 2, Line 33in particular.
Page 2, Line 34(3) If not otherwise specified in the policy, a school
Page 2, Line 35principal, school leader, or school district leader implementing
Page 2, Line 36the policy shall determine the time, place, and manner of the
Page 2, Line 37youth service organization's presentation on school campus
Page 2, Line 38during the school day.
Page 2, Line 39(4) A youth service organization that is permitted to
Page 2, Line 40communicate with students pursuant to the policy developed by
Page 2, Line 41a local education provider shall comply with any other policies,
Page 2, Line 42procedures, or rules established by the local education
Page 2, Line 43provider.
Page 3, Line 1(5) Before the start of the 2026-27 academic school year,
Page 3, Line 2each local education provider shall post the policy on its
Page 3, Line 3website.".
