Bill Summary

Joint Budget Committee. The bill requires the office of the state controller (office) to transfer, unless otherwise provided, on June 30, 2025, and each June 30 thereafter, the balance of any repealed cash fund to the general fund. The bill requires the office to annually submit a report to the joint budget committee that:
- Identifies any funds that have not been appropriated from in the last 2 state fiscal years and the balance of those funds; and
- Identifies the total amount that the office has transferred to the general fund from repealed cash funds.

Page 2, Line 2SECTION 1. In Colorado Revised Statutes, add 24-75-404 as follows:
Page 2, Line 324-75-404. Repealed cash funds - unused cash funds.
Page 2, Line 4(1) Unless otherwise provided by law, on June 30, 2025, and on
Page 2, Line 5each June 30 thereafter, the office of the state controller shall
Page 2, Line 6transfer the balance of any repealed cash fund to the general fund.
Page 2, Line 7(2) On or before November 1, 2025, and each November 1
Page 2, Line 8thereafter, the office of the state controller shall submit a
Page 2, Line 9report to the joint budget committee of the general assembly that:
Page 2, Line 10(a) Identifies any cash fund that has been inactive, other
Page 2, Line 11than the crediting of interest and income from the deposit of
Page 2, Line 12money in the cash fund, for the immediately preceding two state fiscal years and the balance of those funds; and
Page 2, Line 13(b) Identifies the total amount that the state controller
Page 2, Line 14transferred to the general fund in the preceding state fiscal year pursuant to subsection (1) of this section.

Page 2, Line 16determines, and declares that this act is necessary for the immediate
Page 2, Line 17preservation of the public peace, health, or safety or for appropriations for
Page 2, Line 18the support and maintenance of the departments of the state and state institutions.
