Bill Summary

Sunset Process - Senate Transportation and Energy Committee. The bill implements the recommendations of the department of regulatory agencies (department) regarding the motorcycle operator training program (MOST program), as contained in the department's sunset review of the MOST program, as follows:

• Continues the MOST program in the office of the chief of the state patrol in the department of public safety for 9 years, until September 1, 2034 (sections 1 and 2 of the bill);
• Lowers the required minimum age to be a MOST instructor from 21 to 18 years of age (section 3);
• Removes the authority of the motorcycle operator safety advisory board to make recommendations on expenditures of money from the MOST fund (section 4); and
• Makes a technical change to align with the placement of the MOST program within the Colorado state patrol rather than the department of transportation (section 5).

• Page 2, Line 6(XII)  The motorcycle operator safety training program created in part 5 of article 5 of title 43.

• Page 2, Line 1043-5-507.  Repeal of part. This part 5 is repealed, effective

• Page 3, Line 1September 1, 2025 September 1, 2034. Before the repeal, this part 5 is scheduled for review in accordance with section 24-34-104.

• Page 3, Line 343-5-503.  MOST instructor requirements and training. (2)  To be eligible, each applicant for an instructor certificate must:

• Page 3, Line 5SECTION 4.  In Colorado Revised Statutes, 43-5-505, amend (2)(b) and (2)(c); and repeal (2)(d) as follows:

• Page 3, Line 1043-5-501.  Definitions. As used in this part 5, unless the context otherwise requires:

• Page 3, Line 11(3.6)  "MOST vendor" means a person that offers a motorcycle

• Page 3, Line 12operator safety training program that meets standards promulgated by the department of transportation state patrol.

• Page 3, Line 13SECTION 6.  Act subject to petition - effective date. This act

• Page 3, Line 14takes effect at 12:01 a.m. on the day following the expiration of the

• Page 3, Line 15ninety-day period after final adjournment of the general assembly; except

• Page 3, Line 16that, if a referendum petition is filed pursuant to section 1 (3) of article V

• Page 3, Line 17of the state constitution against this act or an item, section, or part of this

• Page 3, Line 18act within such period, then the act, item, section, or part will not take

• Page 4, Line 1effect unless approved by the people at the general election to be held in

• Page 4, Line 2November 2026 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
