Sunset Process - Senate Judiciary Committee. The bill repeals the commodity metals theft task force as recommended in the 2024 sunset report.

(a) There is hereby created thePage 2, Line 11
commodity metals theft task force, also referred to in this subsection (9) as the "task force".Page 2, Line 12
(b) The task force consists of the following ten persons or their designees:Page 2, Line 13
(I) The chief of the Colorado state patrol;(II) A sheriff appointed by a Colorado sheriffs' association;Page 2, Line 14
(III) A municipal police chief appointed by the Colorado association of chiefs of police;Page 2, Line 15
(IV) A contractor that uses commodity metals in construction;Page 2, Line 16
(V) A representative of a national trade association or otherPage 2, Line 17
organization that represents commodity metals recyclers, such as thePage 3, Line 1
institute of scrap recycling industries, incorporated, or its successor organization or another entity representing comparable interests;Page 3, Line 2
(VI) A scrap metal dealer located in Colorado who is a memberPage 3, Line 3
of the institute of scrap recycling industries, incorporated, or its successor organization;Page 3, Line 4
(VII) A representative of the Colorado municipal league, or its successor entity;Page 3, Line 5
(VIII) A representative of Colorado counties, incorporated, or its successor entity;Page 3, Line 6
(IX) A representative of a public utility that uses commodity metals; andPage 3, Line 7
(X) A representative of a railroad company that operates in Colorado.Page 3, Line 8
(c) The task force shall meet on a regular basis, convening at leastPage 3, Line 9
every October, to discuss issues related to theft of commodity metals orPage 3, Line 10
detached catalytic converters, including sharing relevant information onPage 3, Line 11
theft of scrap metal, identifying ways in which Colorado's laws regulatingPage 3, Line 12
commodity metal and detached catalytic converter purchases can bePage 3, Line 13
improved to reduce theft, and reviewing any performance problems or communication issues. The task force is specifically directed to consider:Page 3, Line 14
(I) Possible policies or practices to aid in tracking or apprehendingPage 3, Line 15
stolen commodity metals or detached catalytic converters prior to thePage 3, Line 16
point of sale in order to assist law enforcement personnel in theft prevention and recovery of stolen materials;Page 3, Line 17
(II) Recommendations regarding when and how a commodityPage 3, Line 18
metal or detached catalytic converter purchaser should be required toPage 3, Line 19
apprise local law enforcement authorities if a purchased commodity metalPage 4, Line 1
or detached catalytic converter is a potential match of a commodity metalPage 4, Line 2
or detached catalytic converter reported stolen in the scrap theft alert system; andPage 4, Line 3
(III) The creation and attributes of a civil penalty process forPage 4, Line 4
egregious and repeat violators of the record-keeping requirements of this section.Page 4, Line 5
(d) A member of the task force, as designated by the task force,Page 4, Line 6
shall report annually to the judiciary committees of the house ofPage 4, Line 7
representatives and the senate, or any successor committees, regarding the task force's meetings, findings, and recommendations.Page 4, Line 8
(e) Members of the task force shall not be compensated for, or reimbursed for expenses incurred in, attending meetings of the task force.Page 4, Line 9
(f) This subsection (9) is repealed, effective September 1, 2025.Page 4, Line 10
Before the repeal, the commodity metals theft task force, created pursuantPage 4, Line 11
to this subsection (9), shall be reviewed as provided in section 2-3-1203, C.R.S.Page 4, Line 12(12) (d)
On or before December 1, 2023, and each December 1Page 4, Line 13
thereafter, the Colorado state patrol shall provide a summary of thePage 4, Line 14
assessment reports to the task force and the task force shall consider the report at a meeting required by subsection (9)(c) of this section.Page 4, Line 15(13) (d)
The Colorado state patrol shall provide a summary reportPage 4, Line 16
of all statewide inspections to the task force and the task force shallPage 4, Line 17
consider the report at a meeting required by subsection (9)(c) of this section.Page 4, Line 18SECTION 3. Act subject to petition - effective date. This act

Page 4, Line 20ninety-day period after final adjournment of the general assembly; except
Page 5, Line 1that, if a referendum petition is filed pursuant to section 1 (3) of article V
Page 5, Line 2of the state constitution against this act or an item, section, or part of this
Page 5, Line 3act within such period, then the act, item, section, or part will not take
Page 5, Line 4effect unless approved by the people at the general election to be held in
Page 5, Line 5November 2026 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
