Concerning an exception to the requirement that members of the Colorado state patrol post a bond.

Be it enacted by the General Assembly of the State of Colorado:

SECTION 1.  In Colorado Revised Statutes, 24-33.5-208, amend (1) introductory portion; and add (2) as follows:

24-33.5-208.  Bonds - exception. (1)  Except as provided in subsection (2) of this section, the members of the Colorado state patrol shall be required to give bond to the state in the amount indicated in this section, to be approved and paid for by the state. The bonds shall be issued by a surety company authorized to do business in the state in the following amounts:

(2)  A member of the Colorado state patrol is not required to give the bond otherwise required by subsection (1) of this section if the Colorado state patrol is self-insured through the Colorado state office of risk management and is eligible to be compensated pursuant to section 24-30-1510.5 (5)(g).

SECTION 2.  Act subject to petition - effective date. This act takes effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly; except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2026 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
