Bill Summary

Joint Budget Committee. Beginning with the 2025-26 budget year, and each budget year thereafter, the state charter school institute (institute) shall not distribute a portion of its appropriated mill levy equalization funds to multi-district online schools that are authorized by the institute.
Beginning in the 2024-25 budget year, if the institute receives additional mill levy revenue from a school district for an institute charter school within the geographic boundary of the school district, the general assembly shall deduct the additional mill levy revenue from the amount necessary to fully fund mill levy equalization.
The bill decreases an appropriation from the state education fund to the department of education for use by the institute for mill levy equalization.

Page 2, Line 2SECTION 1. In Colorado Revised Statutes, 22-30.5-513.1, amend (2)(b); and add (2)(c) and (2)(d) as follows:

Page 2, Line 4- definitions. (2) (b) Subject to annual appropriation, the institute
Page 2, Line 5shall annually distribute the money appropriated for full mill levy
Page 2, Line 6equalization pursuant to subsection (2)(a.5)(I) of this section to the
Page 2, Line 7institute charter schools on an equal per-pupil basis, excluding pupils
Page 2, Line 8enrolled in multi-district online schools, as defined in section
Page 2, Line 922-30.7-102, that are authorized by the institute; except that, in
Page 2, Line 10any budget year, an institute charter school must not receive a per pupil
Page 2, Line 11amount that is greater than the total amount of additional mill levy
Page 2, Line 12revenue, as defined in section 22-32-108.5, that the accounting district for
Page 2, Line 13the institute charter school is authorized to collect, divided by the funded
Page 2, Line 14pupil count, as determined pursuant to article 54 of this title 22, of the
Page 2, Line 15accounting district for the applicable budget year. The money distributed
Page 2, Line 16pursuant to this section is in addition to money distributed to institute charter schools pursuant to section 22-30.5-513.
Page 2, Line 17(c) Notwithstanding any provision of this section to the
Page 2, Line 18contrary, beginning with the 2025-26 budget year, and each
Page 3, Line 1budget year thereafter, the institute shall not distribute a

Page 3, Line 3multi-district online school, as defined in section 22-30.7-102, that is authorized by the institute.
