Page 5, Line 5(2) (a) (II) For the 1999-2000 budget year, the charter school and

Page 5, Line 7percent of the district per pupil revenues.
Page 5, Line 8(III) (A) For the 2000-01 budget year through the 2025-26 budget
Page 5, Line 9year, except as otherwise provided in subsection (2)(a.3) of this section,
Page 5, Line 10each charter school and the chartering school district shall negotiate

Page 5, Line 40(a.4) (I) Within ninety days after the end of each fiscal year, each
Page 5, Line 41school district shall provide to each charter school within its district an
Page 5, Line 42itemized accounting of all its central administrative overhead costs. If the
Page 5, Line 43itemized accounting includes services provided to the charter school by
Page 6, Line 1school district personnel, the itemized accounting, at the charter school's
Page 6, Line 2request, must include a list of the personnel positions and services
Page 6, Line 3provided by persons in each position. The actual central administrative
Page 6, Line 4overhead costs are the amount charged to the charter school. Any
Page 6, Line 5difference, within the limitations of subparagraph (III) of paragraph (a)
Page 6, Line 6of this subsection (2) and paragraph (a.3) of this subsection (2)
Page 6, Line 7subsection (2)(a) of this section, between the amount initially charged
Page 6, Line 8to the charter school and the actual cost must be reconciled and paid to
Page 6, Line 9the owed party.
Page 6, Line 10(a.5) As used in this subsection (2):
Page 6, Line 11(II) "District per pupil revenues" means the district's total program
Page 6, Line 12as defined in section 22-54-103 (6) for any budget year divided by the
Page 6, Line 13district's funded pupil count as determined by section 22-54-104 for the
Page 6, Line 14applicable budget year.
Page 6, Line 15(II.5) "District per pupil online funding" means a school district's
Page 6, Line 16online funding, as determined by article 54 of this title 22, divided by the
Page 6, Line 17district's online pupil enrollment for any budget year.
Page 6, Line 18(a.8) (I) For the 2000-01 budget year through the 2025-26 budget
Page 6, Line 19year, The school district shall provide federally required educational
Page 6, Line 20services to students enrolled in charter schools on the same basis as the
Page 6, Line 21services are provided to students enrolled in other public schools of the
Page 6, Line 22school district. Each charter school shall pay an amount equal to the per
Page 6, Line 23pupil cost incurred by the school district in providing federally required
Page 6, Line 24educational services, multiplied by the number of students enrolled in the
Page 6, Line 25charter school. At either party's request, however, the charter school and
Page 6, Line 26the school district may negotiate and include in the charter contract
Page 6, Line 27alternate arrangements for the provision of and payment for federally
Page 6, Line 28required educational services.
Page 6, Line 29(II) Notwithstanding any provision of subparagraph (I) of this
Page 6, Line 30paragraph (a.8) subsection (2)(a.8)(I) of this section to the contrary,
Page 6, Line 31the school district shall calculate the per pupil cost of providing federally
Page 6, Line 32required educational services after subtracting the amount received in
Page 6, Line 33federal and state moneys money for providing said the services.
Page 6, Line 34(a.9) For the 2002-03 budget year through the 2025-26 budget
Page 6, Line 35year, and In accordance with section 22-30.5-406, the funding provided
Page 6, Line 36by a chartering school district to a charter school pursuant to this
Page 6, Line 37subsection (2) is reduced by the amount of any direct payments of
Page 6, Line 38principal and interest due on bonds issued on behalf of a charter school
Page 6, Line 39by a governmental entity other than a school district for the purpose of
Page 6, Line 40financing charter school capital construction that were made by the state
Page 6, Line 41treasurer or the chartering school district on behalf of the charter school.
Page 6, Line 42(c) (II) For the 2000-01 budget year through the 2025-26 budget
Page 6, Line 43year, the amount of funding received by a charter school pursuant to this
Page 7, Line 1subsection (2) shall not be less than one hundred percent of the chartering
Page 7, Line 2school district's district per pupil revenues, minus up to five percent as
Page 7, Line 3provided in subsection (2)(a)(III) of this section multiplied by the number
Page 7, Line 4of pupils enrolled in the charter school or as otherwise provided in
Page 7, Line 5subsection (2)(a.3) of this section for any charter school chartered by a
Page 7, Line 6school district that enrolls five hundred or fewer students.
Page 7, Line 7(c.3) For purposes of subsections (2)(c.5) and (2)(c.7) of this
Page 7, Line 8section, unless the context otherwise requires:
Page 7, Line 9(I) "Charter school's at-risk pupils" means the number of
Page 7, Line 10pupils enrolled in the charter school who are at-risk pupils, as
Page 7, Line 11defined in section 22-54-103 (1.5).
Page 7, Line 12(II) "Charter school's English language learner pupils"
Page 7, Line 13means the number of pupils enrolled in the charter school who
Page 7, Line 14are English language learner pupils, as defined in section
Page 7, Line 1522-54-103 (6.5).
Page 7, Line 16(III) "Charter school's percentage of at-risk pupils" means
Page 7, Line 17the number of at-risk pupils enrolled in the charter school,
Page 7, Line 18divided by the charter school's pupil enrollment.
Page 7, Line 19(IV) "Charter school's pupil enrollment" means the
Page 7, Line 20number of pupils enrolled in the charter school who are part of
Page 7, Line 21pupil enrollment, as defined in section 22-54-103 (10).
Page 7, Line 22(V) "Charter school's special education pupil enrollment"
Page 7, Line 23means the number of pupils enrolled in the charter school who
Page 7, Line 24are special education pupils, as defined in section 22-54-103 (10.8).
Page 7, Line 25(c.5) (I) For the 2026-27 budget year, a school district
Page 7, Line 26shall determine each of its charter schools' phase-in amounts of
Page 7, Line 27district total program. Each charter school's phase-in amount
Page 7, Line 28of district total program is the amount calculated by the
Page 7, Line 29school district using the calculation described in section
Page 7, Line 3022-54-103.3 (3)(b); except that, when making the calculations, the
Page 7, Line 31school district shall:
Page 7, Line 32(A) Use the charter school's pupil enrollment for the

Page 8, Line 29charter school for the 2025-26 budget year plus one percent of

Page 8, Line 35(IV) This subsection (2)(c.5) is repealed, effective July 1,

Page 8, Line 37(c.7) (I) For each budget year beginning with the 2027-28
Page 8, Line 38budget year through the 2030-31 budget year, a school district
Page 8, Line 39shall determine each of its charter schools' phase-in amounts of
Page 8, Line 40district total program. Each charter school's phase-in amount
Page 8, Line 41of district total program is the amount calculated by the
Page 8, Line 42school district using the calculation described in section
Page 8, Line 4322-54-103.3 (3)(c) for the applicable budget year; except that,

Page 16, Line 11adjusted per pupil revenues multiplied by the number of pupils enrolled
Page 16, Line 12in the institute charter school who are not online pupils plus an amount
Page 16, Line 13equal to one hundred percent of the accounting district's per pupil online
Page 16, Line 14funding multiplied by the number of online pupils enrolled in the institute
Page 16, Line 15charter school. The department shall forward to the institute the amount
Page 16, Line 16withheld minus an amount not to exceed one percent of the amount
Page 16, Line 17withheld that the department may retain as reimbursement for the
Page 16, Line 18reasonable and necessary costs to the department to implement the
Page 16, Line 19provisions of this part 5.
Page 16, Line 20(I.5) For each budget year through the 2025-26 budget year, The
Page 16, Line 21institute shall forward to each institute charter school an amount equal to
Page 16, Line 22the institute charter school's pupil enrollment multiplied by the accounting
Page 16, Line 23district's adjusted per pupil revenues of the institute charter school's
Page 16, Line 24accounting district, minus:
Page 16, Line 25(c) For budget years 2004-05 through 2010-11, the amount of
Page 16, Line 26funding specified in paragraph (a) of this subsection (4) shall reflect the
Page 16, Line 27one-percent increase in the statewide base per pupil funding for state
Page 16, Line 28fiscal years 2001-02 through 2010-11 received by school districts as
Page 16, Line 29required by section 17 of article IX of the state constitution.
Page 16, Line 30(5.5) (a) Notwithstanding any provision of this section to the
Page 16, Line 31contrary, if a district charter school converts to an institute charter school
Page 16, Line 32pursuant to section 22-30.5-510, the converted school's per pupil revenues
Page 16, Line 33or adjusted per pupil revenues, whichever is applicable, and at-risk
Page 16, Line 34supplemental aid continue to be calculated pursuant to section
Page 16, Line 3522-30.5-112, or 22-30.5-112.1 whichever is applicable, and section
Page 16, Line 3622-30.5-112.2, total program funding as the funding applied to the
Page 16, Line 37converted school before the conversion; except that this subsection (5.5)
Page 16, Line 38does not apply if the converted school was authorized by a small rural
Page 16, Line 39school district, as described in section 22-54-108 (3)(b)(IV), before the
Page 16, Line 40conversion.
Page 16, Line 41(10) (a) On or before December 1, 2009, and on or before
Page 16, Line 42December 1 each year, thereafter, a representative from the governing
Page 16, Line 43board of each institute charter school and the institute board shall meet to
Page 17, Line 1review the level of funding received by the institute as a result of the
Page 17, Line 2money withheld by the institute for the amount of actual costs incurred by
Page 17, Line 3the institute in providing necessary administration, oversight, and
Page 17, Line 4management services to the institute charter schools. The institute charter
Page 17, Line 5school representatives and the institute board shall, at a minimum, review,
Page 17, Line 6for each budget year, beginning with the 2004-05 budget year through the
Page 17, Line 72025-26 budget year, the amount of money annually appropriated to the
Page 17, Line 8institute, the amount of costs incurred by the institute, and the services
Page 17, Line 9provided by the institute.
Page 17, Line 10(11) (a) For the 2022-23 budget year, the general assembly shall
Page 17, Line 11appropriate three hundred seventy-five thousand dollars from the general
Page 17, Line 12fund to the institute to distribute to eligible institute charter schools.
Page 17, Line 13(b) As used in this subsection (11), "eligible institute charter
Page 17, Line 14school" means an institute charter school, at least fifty percent of the
Page 17, Line 15student population of which receives special education services through
Page 17, Line 16the administrative unit of the institute.
