Bill Summary

The bill requires a wholesaler or supplier of a gas-fueled stove (stove) to, prior to selling a stove to a consumer in the state, affix an adhesive label to the stove with the phrase "This appliance should be ventilated to the exterior when in use."
Before transacting an online sale of a stove to an address in the state, a wholesaler or supplier is required to post the same phrase on the internet website where the online sale occurs.
The bill specifies that a violation of the requirements of the bill is a deceptive trade practice under the "Colorado Consumer Protection Act".

LABELING OF GAS-FUELED STOVES
Page 2, Line 425-5-1601. Definitions.As used in this part 16, unless the context otherwise requires:
Page 2, Line 5(1) "Department" means the department of public health and environment created in section 25-1-102.
Page 2, Line 6(2) "Gas-fueled stove" means a household stove, range, or
Page 2, Line 7cooktop that directly combusts a gaseous or liquid fuel, is used
Page 2, Line 8for indoor food preparation, and provides at least one of the following functions:
Page 2, Line 9(a) Surface cooking;
(b) Oven cooking; or
Page 2, Line 10(c) Broiling.
Page 2, Line 1125-5-1602. Labeling requirements - public information on the
Page 2, Line 12department's website. (1) (a) A retailer shall not sell, attempt to
Page 2, Line 13sell, or offer to sell, in a store, a new gas-fueled stove to a
Page 2, Line 14potential consumer in the state unless a yellow adhesive label
Page 2, Line 15on the display model for the gas-fueled stove bears the
Page 2, Line 16following statement in bold-faced, black type that is clearly legible in English and Spanish:

Page 2, Line 18having an indoor gas stove.
Page 3, Line 1(b) Following the statement described in subsection (1)(a)
Page 3, Line 2of this section, the adhesive label must include a website link or
Page 3, Line 3a quick response (QR) code or other machine-readable code that
Page 3, Line 4a potential consumer may use to access the web page established by the department pursuant to subsection (4) of this section.

Page 3, Line 6subsection (1) of this section to the display model for a new
Page 3, Line 7gas-fueled stove on a horizontal surface in a prominent position
Page 3, Line 8that is capable of being easily read by a potential consumer

Page 3, Line 13content of the adhesive label described in subsection (1) of this section for the potential consumer.

Page 3, Line 16impacts of gas-fueled stoves. The department may include on the
Page 3, Line 17web page links to technical studies or other resources to assist
Page 3, Line 18the public in understanding the health impacts of gas-fueled stoves.
Page 3, Line 1925-5-1603. Enforcement.A retailer that, in the course of
Page 3, Line 20the retailer's business, violates section 25-5-1602 commits a
Page 3, Line 21deceptive trade practice under the "Colorado Consumer Protection Act", article 1 of title 6.
Page 3, Line 22SECTION 2. In Colorado Revised Statutes, 6-1-105, add (1)(iiii) as follows:

Page 4, Line 2(1) A person engages in a deceptive trade practice when, in the course of the person's business, vocation, or occupation, the person:

Page 4, Line 4SECTION 3. Act subject to petition - effective date -
Page 4, Line 5applicability. (1) This act takes effect at 12:01 a.m. on the day following
Page 4, Line 6the expiration of the ninety-day period after final adjournment of the
Page 4, Line 7general assembly; except that, if a referendum petition is filed pursuant
Page 4, Line 8to section 1 (3) of article V of the state constitution against this act or an
Page 4, Line 9item, section, or part of this act within such period, then the act, item,
Page 4, Line 10section, or part will not take effect unless approved by the people at the
Page 4, Line 11general election to be held in November 2026 and, in such case, will take
Page 4, Line 12effect on the date of the official declaration of the vote thereon by the governor.
Page 4, Line 13(2) This act applies to conduct occurring on or after the applicable effective date of this act.
