A person, including a corporation or governmental agency, commits human trafficking of a minor for an abortion or gender-affirming health-care services if the person transports an out-of-state minor who is under 18 years of age into Colorado for the purpose of assisting the minor in obtaining an abortion or gender-affirming health-care services. The bill classifies human trafficking of a minor for an abortion or gender-affirming health-care services as a class 2 felony.

Page 2, Line 2SECTION 1. In Colorado Revised Statutes, add 18-3-504.5 as follows:
Page 2, Line 318-3-504.5. Human trafficking of a minor for abortion or
Page 2, Line 4gender-affirming health-care services. (1) (a) A person commits
Page 2, Line 5human trafficking of a minor for an abortion or
Page 2, Line 6gender-affirming health-care services if the person transports
Page 2, Line 7an out-of-state minor into Colorado for the purpose of assisting
Page 2, Line 8the minor in obtaining an abortion, as defined in section 25-6-402,
Page 2, Line 9or gender-affirming health-care services, as defined in section 12-30-121.
Page 2, Line 10(b) Human trafficking of a minor for an abortion or gender-affirming health-care services is a class 2 felony.
Page 2, Line 11(2) In any prosecution brought pursuant to subsection (1) of this section, it is not a defense that:
Page 2, Line 12(a) The minor consented to being transferred by the
Page 2, Line 13defendant for the purpose of obtaining an abortion or gender-affirming health-care services;
Page 2, Line 14(b) The minor consented to obtaining an abortion or gender-affirming health-care services;
Page 2, Line 15(c) The defendant did not know the minor's age or
Page 2, Line 16reasonably believed the minor to be eighteen years of age or
Page 2, Line 17older; or
Page 3, Line 1(d) The minor or another person represented the minor to be eighteen years of age or older.
Page 3, Line 2SECTION 2. Act subject to petition - effective date. This act
Page 3, Line 3takes effect at 12:01 a.m. on the day following the expiration of the
Page 3, Line 4ninety-day period after final adjournment of the general assembly; except
Page 3, Line 5that, if a referendum petition is filed pursuant to section 1 (3) of article V
Page 3, Line 6of the state constitution against this act or an item, section, or part of this
Page 3, Line 7act within such period, then the act, item, section, or part will not take
Page 3, Line 8effect unless approved by the people at the general election to be held in
Page 3, Line 9November 2026 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
