Bill Summary

Joint Budget Committee. The bill provides that the following funds are no longer continuously appropriated for use by the following executive branch agencies, and instead are available to be expended by those departments subject to annual appropriation by the general assembly:

• The child welfare cash fund for use by the department of human services;
• The community impact cash fund for use by the department of public health and environment;
• The accelerated appeal cash fund for use by the board of assessment appeals within the department of local affairs;
• The mobile home park act dispute resolution and enforcement program fund for use by the division of housing in the department of local affairs;
• The public safety communications revolving fund for use by the office of public safety communications in the division of homeland security and emergency management in the department of public safety; and
• The state agency sustainability revolving fund for use by the department of personnel.

For the 2025-26 state fiscal year, the bill appropriates $284,167 from the child welfare cash fund to the department of human services for use by the division of child welfare for child welfare licensing.

• Page 2, Line 2SECTION 1.  In Colorado Revised Statutes, 26-6-921, amend (4)(b) as follows:

• Page 2, Line 326-6-921.  Civil penalties - fines - child welfare cash fund -

• Page 2, Line 4created. (4) (b)  The balance as of July 1, 2022, in the child care cash

• Page 2, Line 5fund, created pursuant to section 26-6-114 (5), as it existed prior to July

• Page 2, Line 61, 2022, that is attributable to fines and civil penalties collected by the

• Page 2, Line 7division in the department that is responsible for child welfare is hereby

• Page 2, Line 8transferred to the child welfare cash fund, which fund is hereby created

• Page 2, Line 9in the state treasury. The treasurer shall credit all interest derived from the

• Page 2, Line 10deposit and investment of money in the child welfare cash fund to the

• Page 2, Line 11fund. At the end of a fiscal year, all unexpended and unencumbered

• Page 2, Line 12money in the child welfare cash fund remains in the fund and is not

• Page 2, Line 13credited or transferred to the general fund or any other fund. Money in the

• Page 3, Line 1child welfare cash fund is continuously appropriated to Subject to

• Page 3, Line 7- repeal. (3) (e)  Money in the fund is continuously appropriated to

• Page 3, Line 8Subject to annual appropriation by the general assembly, the

• Page 3, Line 9department may expend money from the fund to accomplish the purposes set forth in this subsection (3).

• Page 3, Line 10SECTION 3.  In Colorado Revised Statutes, 39-2-125, amend (2.5)(b)(II) as follows:

• Page 3, Line 12cash fund - creation - accelerated appeal cash fund. (2.5) (b)  The

• Page 3, Line 13board of assessment appeals may charge a fee to a taxpayer whose appeal is advanced pursuant to this subsection (2.5). The fee must be:

• Page 4, Line 2enforcement program fund. (1)  There is hereby created in the state

• Page 4, Line 3treasury the mobile home park act dispute resolution and enforcement

• Page 4, Line 4program fund. All money collected pursuant to the program must be

• Page 4, Line 5deposited in the fund. The fund shall be used by the division for the costs

• Page 4, Line 6associated with administering the program. The money in the fund shall

• Page 4, Line 7be continuously appropriated for administering Subject to annual

• Page 4, Line 8appropriation by the general assembly, the division may expend

• Page 4, Line 9money from the fund to administer the program. All interest and

• Page 4, Line 10income derived from the investment and deposit of money in the fund

• Page 4, Line 11shall be credited to the fund. Any unexpended and unencumbered money

• Page 4, Line 12remaining in the fund at the end of a fiscal year shall remain in the fund

• Page 4, Line 13and shall not be credited or transferred to the general fund or another fund.

• Page 4, Line 19fund to pay the direct and indirect costs, including personal services and

• Page 4, Line 20operating costs, associated with administering public safety communications.

• Page 4, Line 21SECTION 6.  In Colorado Revised Statutes, 24-30-2304, amend (4) as follows:

• Page 4, Line 2224-30-2304.  Revolving fund - definition. (4)  Money in the fund

• Page 4, Line 23is continuously appropriated to Subject to annual appropriation by

• Page 5, Line 1the general assembly, the department may expend money from the

• Page 5, Line 2fund to be used for the purposes specified in subsection (2) of this section.

• Page 5, Line 3SECTION 7.  Appropriation.  For the 2025-26 state fiscal year,

• Page 5, Line 4$284,167 is appropriated to the department of human services for use by

• Page 5, Line 5the division of child welfare. This appropriation is from the child welfare

• Page 5, Line 6cash fund created in section 26-6-921 (4)(b), C.R.S. To implement this act, the division may use this appropriation for child welfare licensing.

• Page 5, Line 7SECTION 8.  Effective date. This act takes effect July 1, 2025.
