The bill clarifies that a special district may cancel an election in a director district if the only matter to be decided at the election is who will be director of the director district, there are not more candidates than positions for director, and the only individuals who may vote are the eligible electors within the director's district.

Page 2, Line 2SECTION 1. In Colorado Revised Statutes, 1-13.5-513, amend (4); and add (3.5) as follows:
Page 2, Line 31-13.5-513. Election may be canceled - when - definition.
Page 2, Line 4(3.5) (a) If, pursuant to section 32-1-902.7, the board of directors
Page 2, Line 5of a special district has adopted a resolution to divide the
Page 2, Line 6special district into director districts and has designated that
Page 2, Line 7the directors representing the director districts must be
Page 2, Line 8elected by the eligible electors within each director district,
Page 2, Line 9then the governing body may cancel the election for one or
Page 2, Line 10more director districts if, with respect to each such director
Page 2, Line 11district, all the conditions of subsection (1) of this section exist
Page 2, Line 12and all ballot issues or ballot questions, if any, have been
Page 2, Line 13withdrawn from the ballot pursuant to subsection (2) of this section.
Page 2, Line 14(b) As used in this subsection (3.5), "director district"
Page 2, Line 15means the area represented by one director within a special
Page 2, Line 16district in which the board has adopted a resolution to divide
Page 2, Line 17the special district into director districts pursuant to section 32-1-902.7.

Page 2, Line 20applicability. (1) This act takes effect at 12:01 a.m. on the day following
Page 2, Line 21the expiration of the ninety-day period after final adjournment of the
Page 2, Line 22general assembly; except that, if a referendum petition is filed pursuant
Page 3, Line 1to section 1 (3) of article V of the state constitution against this act or an
Page 3, Line 2item, section, or part of this act within such period, then the act, item,
Page 3, Line 3section, or part will not take effect unless approved by the people at the
Page 3, Line 4general election to be held in November 2026 and, in such case, will take
Page 3, Line 5effect on the date of the official declaration of the vote thereon by the governor.
Page 3, Line 6(2) This act applies to elections held on or after the applicable effective date of this act.
