Page 1, Line 12system's collective data-sharing feature.
Page 1, Line 13(b) This section does not apply to a law enforcement
Page 1, Line 14agency that has a preexisting relationship with another law
Page 1, Line 15enforcement agency that allows the law enforcement agency
Page 1, Line 16to submit a firearm to the electronic tracing system, including
Page 1, Line 17the system's collective data-sharing feature, the Colorado
Page 1, Line 18state patrol, or the Colorado bureau of investigation.
Page 1, Line 19(2) (a) When a law enforcement agency recovers or
Page 1, Line 20confiscates a firearm, the agency shall, as soon as practicable,
Page 1, Line 21but no later than ninety days after the agency recovers or
Page 1, Line 22confiscates the firearm, transmit the relevant information
Page 1, Line 23regarding the firearm to the national tracing center's
Page 1, Line 24electronic tracing system.
Page 1, Line 25(b) A law enforcement agency that receives a
Page 2, Line 1voluntarily relinquished firearm or recovers a firearm that the
Page 2, Line 2agency determines is not connected with a criminal
Page 2, Line 3investigation or criminal activity does not need to transmit the
Page 2, Line 4relevant information regarding the firearm to the electronic
Page 2, Line 5tracing system.
Page 2, Line 6(3) As used in this section, unless the context otherwise
Page 2, Line 7requires:
Page 2, Line 8 (a) "Law enforcement agency" means a law enforcement
Page 2, Line 9entity having original jurisdiction over a firearms-related
Page 2, Line 10crime investigation, including:
Page 2, Line 11(I) A municipal police department;
Page 2, Line 12(II) A sheriff's office of a county or city and county;
Page 2, Line 13(III) A campus police department;
Page 2, Line 14(IV) A town marshal's office; and
Page 2, Line 15(V) A police officer employed pursuant to article 9 of
Page 2, Line 16title 32.
Page 2, Line 17(b) "Recover or confiscate" means:
Page 2, Line 18(I) A law enforcement agency obtaining an item from a
Page 2, Line 19crime scene or an item in connection with a criminal
Page 2, Line 20investigation;
Page 2, Line 21(II) A law enforcement agency seizing, or a person
Page 2, Line 22forfeiting to a law enforcement agency, an item in connection
Page 2, Line 23with a criminal proceeding, investigation, or conviction;
Page 2, Line 24(III) A law enforcement agency seizing, or a person
Page 2, Line 25forfeiting to a law enforcement agency, an item in connection
Page 2, Line 26with a crime that has an underlying factual basis of domestic
Page 2, Line 27violence, as defined in section 18-6-800.3 (1);
Page 2, Line 28(IV) A law enforcement agency acquiring an abandoned
Page 2, Line 29or discarded firearm; or
Page 2, Line 30(V) A law enforcement agency otherwise obtaining an
Page 2, Line 31item believed to be connected with a crime.".
