After consideration on the merits, the Committee recommends the following:

SB26-113     be amended as follows, and as so amended, be referred to the Committee of the Whole with favorable recommendation:

Page 1, Line 2"(b) (I)  A recovery residence that is certified pursuant to

Page 1, Line 3section 27-80-129 as of June 30, 2027, shall give notice to the BHA

Page 1, Line 4prior to July 1, 2027, in the form and manner prescribed by the

Page 1, Line 5BHA, that the recovery residence:

Page 1, Line 6(A)  Holds a certification as of June 30, 2027;

Page 1, Line 7(B)  Is in compliance with all applicable rules for

Page 1, Line 8operating a recovery residence adopted pursuant to section

Page 1, Line 927-50-1002; and

Page 1, Line 10(C)  Intends to pursue a recovery residence license from

Page 1, Line 11the BHA pursuant to this section.

Page 1, Line 12(II)  The certified recovery residence may operate in this

Page 1, Line 13state and receive referrals. A certification is in lieu of

Page 1, Line 14licensure until the recovery residence is licensed.

Page 1, Line 15(c) (I)  A certified recovery residence shall submit an

Page 1, Line 16application for licensure to the BHA no less than sixty days

Page 1, Line 17prior to one year after the date the recovery residence's

Page 1, Line 18certification was last issued pursuant to section 27-80-129. The

Page 1, Line 19application must be submitted in the form and manner prescribed

Page 1, Line 20by the BHA pursuant to section 27-50-1003.

Page 1, Line 21(II)  On and after July 1, 2028, a recovery residence

Page 1, Line 22previously certified pursuant to section 27-80-129 shall not

Page 1, Line 23operate without applying and being approved for a license

Page 1, Line 24pursuant to section 27-50-1003.

Page 1, Line 25(d)  Beginning July 1, 2027, a certified recovery residence

Page 1, Line 26shall report the occurrences described in section 27-50-1006 to

Page 1, Line 27the BHA. The reporting requirements in section 27-50-1006

Page 2, Line 1continue to apply after the certified recovery residence

Page 2, Line 2receives a license pursuant to section 27-50-1003.

Page 2, Line 3(e)  Beginning July 1, 2027, the BHA may inspect a recovery

Page 2, Line 4residence as it deems necessary to ensure the recovery

Page 2, Line 5residents' health, safety, and welfare are protected. The

Page 2, Line 6recovery residence shall submit in writing, in the form and

Page 2, Line 7manner prescribed by the BHA, a plan detailing the measures

Page 2, Line 8that the recovery residence will take to correct violations

Page 2, Line 9found by the BHA as a result of inspections conducted pursuant

Page 2, Line 10to this subsection (2)(e). The BHA may take additional actions in

Page 2, Line 11accordance with section 27-50-1005.".
