Page 2, Line 15college authorized pursuant to article 71 of title 23

Page 2, Line 25(IV) Behavioral or mental health;
Page 2, Line 26(V) Intellectual or developmental disability; or
Page 2, Line 27(VI) Ill health.".

Page 3, Line 1(II) The entity shall determine whether the applicant or
Page 3, Line 2the entity pays the costs associated with the fingerprint-based
Page 3, Line 3criminal history record check.
Page 3, Line 4(b) After submitting an application for a
Page 3, Line 5non-employment-based educational opportunity and declining
Page 3, Line 6to provide their social security number, the applicant shall
Page 3, Line 7have the applicant's fingerprints taken by a local law
Page 3, Line 8enforcement agency, or a third party approved by the Colorado
Page 3, Line 9bureau of investigation, to obtain a fingerprint-based criminal
Page 3, Line 10history record check. The applicant shall authorize the third
Page 3, Line 11party taking the applicant's fingerprints to submit, and the third
Page 3, Line 12party shall submit, the complete set of the applicant's
Page 3, Line 13fingerprints to the Colorado bureau of investigation to conduct
Page 3, Line 14a fingerprint-based criminal history record check.
Page 3, Line 15(c) If an approved third party takes the person's
Page 3, Line 16fingerprints, the fingerprints may be electronically captured
Page 3, Line 17using livescan equipment approved by the Colorado bureau of
Page 3, Line 18investigation. Third-party vendors shall not keep the
Page 3, Line 19applicant's information for more than thirty days.
Page 3, Line 20(d) The Colorado bureau of investigation shall use the
Page 3, Line 21applicant's fingerprints to conduct a criminal history record
Page 3, Line 22check using the bureau's records. The Colorado bureau of
Page 3, Line 23investigation shall forward the fingerprints to the federal
Page 3, Line 24bureau of investigation for conducting a fingerprint-based
Page 3, Line 25criminal history record check. The Colorado bureau of
Page 3, Line 26investigation, applicant, entity, and third party taking
Page 3, Line 27fingerprints shall comply with the federal bureau of
Page 3, Line 28investigation's requirements for a criminal history record
Page 3, Line 29check.
Page 3, Line 30(e) The Colorado bureau of investigation shall return the
Page 3, Line 31results of its criminal history record check to the entity, and
Page 3, Line 32the entity is authorized to receive the results of the federal
Page 3, Line 33bureau of investigation's criminal history record check. The
Page 3, Line 34entity shall use the information resulting from the criminal
Page 3, Line 35history record checks to investigate and determine whether an
Page 3, Line 36applicant is qualified for an opportunity pursuant to subsection
Page 3, Line 37(2) of this section.
Page 3, Line 38(f) When the results of a criminal history record check of
Page 3, Line 39an applicant performed pursuant to this subsection (7) reveal a
Page 3, Line 40record of arrest without a disposition, the entity shall require
Page 3, Line 41the applicant to submit to a name-based judicial record check,
Page 3, Line 42as defined in section 22-2-119.3 (6)(d).".
