Page 3, Line 20(4) (11)  "Commission" means the Colorado racing commission

Page 3, Line 40responsibility of the licensee of a class B horse track, located in Colorado,

Page 3, Line 41and used for the handling of wagers placed on simulcast races received

Page 3, Line 42by the track or facility. The number of additional facilities cannot exceed

Page 3, Line 43the total number of facilities licensed to hold a race meet in 2003 plus one

Page 4, Line 1additional facility per licensee as authorized under this article 32.

Page 4, Line 2(b)  If an additional facility is jointly owned or operated as a

Page 4, Line 3simulcast facility by two or more licensees, the additional facility shall be

Page 4, Line 4is deemed to be one of the additional simulcast facilities of only one of

Page 4, Line 5the licensees, as designated in writing to the commission.

Page 4, Line 6(c)  The commission, for good cause, may grant a licensed class A

Page 4, Line 7horse track permission to receive simulcast races at an alternate location

Page 4, Line 8within five miles of its track during the times when the track is not in

Page 4, Line 9operation.

Page 4, Line 10(12) (18)  "Interstate common pool" means a pari-mutuel pool

Page 4, Line 11established at one location, usually but not necessarily at a host track,

Page 4, Line 12within which pool are combined comparable pari-mutuel pools of one or

Page 4, Line 13more simulcast facilities upon a race run at the host track for purposes of

Page 4, Line 14establishing payoff prices in the various states. There may be simulcast

Page 4, Line 15facilities in more than one state simultaneously combining pari-mutuel

Page 4, Line 16pools into the common pool of the host track. Where permitted by the

Page 4, Line 17laws and rules of the states in which the host track and the simulcast

Page 4, Line 18facilities are located and with the concurrence of the host track, the

Page 4, Line 19combined pari-mutuel pool may be established on a regional or other

Page 4, Line 20basis between two or more simulcast facilities and need not involve a

Page 4, Line 21merger into the host track's pari-mutuel pool. In such instances, one of the

Page 4, Line 22simulcast facilities shall serve as if it were the host track for the purposes

Page 4, Line 23of holding the common pool and calculating payoffs. The interstate

Page 4, Line 24common pool shall be as specified in the written simulcast racing

Page 4, Line 25agreement between the host track and the person operating the simulcast

Page 4, Line 26facility receiving the simulcast races.

Page 4, Line 27(13) (19)  "Intrastate common pool" means a pari-mutuel pool,

Page 4, Line 28established for an in-state host track, that includes wagers made at the

Page 4, Line 29in-state host track as well as wagers made at in-state simulcast facilities

Page 4, Line 30on simulcast races of live races run at the in-state host track.

Page 4, Line 31(13.3) (20)  "Key occupational license" means a license that is

Page 4, Line 32issued by the division and that is required for an individual who

Page 4, Line 33exercises significant influence over decisions affecting a business

Page 4, Line 34decision-making, management, or financial influence over a

Page 4, Line 35business that is licensed with the commission pursuant to section

Page 4, Line 3644-32-504. A "key occupational license" is required for the

Page 4, Line 37following licensed positions: general manager, assistant

Page 4, Line 38general manager, association veterinarian, director of racing,

Page 4, Line 39racing secretary, corporate director, security director,

Page 4, Line 40association steward, corporate officer, mutuel manager, and

Page 4, Line 41totalisator operator.

Page 4, Line 42(13.7) (21)  "License" means a license granted by the division

Page 4, Line 43pursuant to this article 32.

Page 5, Line 1(14) (22) (a)  "Licensee" means:

Page 5, Line 2(I)  any A person holding a current, valid race meet license issued

Page 5, Line 3pursuant to section 44-32-505; and

Page 5, Line 4(II)  any A person holding a current, valid license or registration

Page 5, Line 5issued by the commission pursuant to sections 44-32-503 and 44-32-504;

Page 5, Line 10(b)  The commission, by rule, shall determine which occupational

Page 5, Line 14(15) (23)  "Out-of-state host track" means a track, located within

Page 5, Line 15a state other than Colorado, that is licensed or otherwise properly

Page 5, Line 16authorized under the laws of the state to conduct live races of horses and

Page 5, Line 17to broadcast the races as simulcast races and that broadcasts the simulcast

Page 5, Line 18races to an in-state simulcast facility.

Page 5, Line 19(16) (24)  "Out-of-state simulcast facility" means a track or other

Page 5, Line 20facility, located within a jurisdiction other than Colorado, at which

Page 5, Line 21pari-mutuel wagers are placed or accepted, either in person or

Page 5, Line 22electronically, on simulcast races pursuant to proper authorization under

Page 5, Line 23the laws of the jurisdiction.

Page 5, Line 24(17) (25)  "Pari-mutuel pool" means a wagering pool into which

Page 5, Line 25pari-mutuel wagers on a live race or on a simulcast race are taken.

Page 5, Line 26(18) (26)  "Pari-mutuel wagering" means a form of wagering on

Page 5, Line 27the outcome of horse races in which those who wager purchase tickets of

Page 5, Line 28various denominations on one or more horses from one or more pools and

Page 5, Line 29all like wagers from each race are pooled and the winning ticket holders

Page 5, Line 30are paid prizes from the pool in amounts proportional to the total receipts

Page 5, Line 31in the pool minus deductions authorized by statute.

Page 5, Line 32(19) (27)  "Person" means any an individual, a partnership, a firm,

Page 5, Line 33a corporation, or an association.

Page 5, Line 34(20) (28) (a)  "Race meet", or "meet", means any a live exhibition

Page 5, Line 35of racing involving horses registered within their breed, conducted at a

Page 5, Line 36track located within the state of Colorado and operated by a licensee

Page 5, Line 37under a license granted pursuant to section 44-32-505, where the

Page 5, Line 38pari-mutuel system of wagering is used.

Page 5, Line 39(b)  "Race meet" or "meet" includes the total, continuous

Page 5, Line 40period during which a racing association or track premises is

Page 5, Line 41under the full regulatory jurisdiction of the division, which

Page 5, Line 42period encompasses:

Page 5, Line 43(I)  The live racing period, which is all licensed days

Page 6, Line 1approved by the commission for the conduct of live, competitive

Page 6, Line 2horse racing;

Page 6, Line 3(II)  The premeet regulatory period, which is the entire

Page 6, Line 4period commencing on the first day the licensed track premises

Page 6, Line 5are made available for or utilized for receiving horses,

Page 6, Line 6conducting official regulated training, or performing official

Page 6, Line 7premeet regulatory inspections, whichever occurs earliest; and

Page 6, Line 8(III)  The post-meet regulatory period, which is seven

Page 6, Line 9calendar days immediately following and including the final

Page 6, Line 10licensed day of live racing conducted by a racing association

Page 6, Line 11for the calendar year.

Page 6, Line 12(29)  "Registration occupational license" means a license

Page 6, Line 13that is issued by the division to an individual who has short-term

Page 6, Line 14commitments to perform services for a track or race meet. A

Page 6, Line 15"registration occupational license" is valid for no longer than

Page 6, Line 16ninety days and is required by the following temporary licensed

Page 6, Line 17positions: Announcer, concession employee, nurse or emergency

Page 6, Line 18medical technician, office personnel, racing club association,

Page 6, Line 19track shop employee, temporary tote operator, temporary tote

Page 6, Line 20technician, user, and video technician.

Page 6, Line 21(21) (30)  "Simulcast facility" means either an in-state simulcast

Page 6, Line 22facility or an out-of-state simulcast facility.

Page 6, Line 23(22) (31)  "Simulcast race" means a live, audio-visual broadcast

Page 6, Line 24that is:

Page 6, Line 25(a)  Transmitted simultaneously with either:

Page 6, Line 26(I)  The performance of a live race of horses by an out-of-state host

Page 6, Line 27track; or

Page 6, Line 28(II)  The performance of a live race of horses by an in-state host

Page 10, Line 14record check to ensure applicant eligibility, protect public

Page 10, Line 15safety, and maintain the integrity of licensed professions. The

Page 10, Line 16Colorado bureau of investigation shall forward the

Page 10, Line 17fingerprints to the federal bureau of investigation for the

Page 10, Line 18purpose of conducting a national fingerprint-based criminal

Page 10, Line 19history record check. upon completion, the Colorado bureau of

Page 10, Line 20investigation shall return the results of its criminal history

Page 10, Line 21record check to the commission, and the commission is

Page 10, Line 22authorized to receive the results of the federal bureau of

Page 10, Line 23investigation's criminal history record check. The applicant

Page 10, Line 24shall be responsible for paying the cost of the record check.

Page 10, Line 25nothing in this subsection (4) precludes the commission from

Page 10, Line 26making further inquiries into the background of an applicant.".
