Bill Summary

Joint Budget Committee. The bill repeals the Colorado student leaders institute (institute), created in the department of education (department), on September 1, 2026.

Before the repeal of the institute, the bill requires the department, in collaboration with the host institution of higher education that operates the institute and the advisory committee, to return, to the extent possible, money remaining in the Colorado student leaders institute cash fund (cash fund) to each grantor, donor, or student in an amount that is proportional to the grantor's, donor's, or student's share of the total amount of gifts, grants, donations, or student contributions deposited in the cash fund. If any money remains in the cash fund on August 31, 2025, the state treasurer shall, prior to the repeal of the cash fund, transfer all unexpended and unencumbered money in the cash fund to the general fund.

• Page 2, Line 2SECTION 1.  In Colorado Revised Statutes, 22-106-103, amend (1) as follows:

• Page 2, Line 322-106-103.  Colorado student leaders institute - applications.

• Page 2, Line 4(1)  There is in the department of education the Colorado student leaders

• Page 2, Line 5institute. The year-long institute shall operate a competitive residential

• Page 2, Line 6summer academic program for students who are entering tenth or

• Page 2, Line 7eleventh grade in the coming fall semester. The program operated by the

• Page 2, Line 8institute must be for four weeks each summer during which time students

• Page 2, Line 9who are accepted to the institute attend college-level classes, lectures, and

• Page 2, Line 10seminars as well as enrichment activities, including concerts and

• Page 2, Line 11theatrical productions. Each student who is accepted to the institute is

• Page 2, Line 12encouraged to donate up to four hundred dollars to the institute to assist

• Page 2, Line 13in meeting operational costs. Subject to available appropriations, up to

• Page 2, Line 14one hundred students may annually participate in the institute. The host

• Page 2, Line 15institution and the department shall not operate the Colorado student leaders institute in the 2025-26 state fiscal year.

• Page 2, Line 16SECTION 2.  In Colorado Revised Statutes, amend 22-106-105 as follows:

• Page 2, Line 18fund created. (1) (a)  The general assembly shall annually appropriate

• Page 3, Line 1money to the department of education for the institute to pay the direct

• Page 3, Line 2and indirect costs that the state board of education incurs in operating the

• Page 3, Line 3institute, including costs relating to the host institution and stipends for the institute faculty members.

• Page 3, Line 5appropriated pursuant to this subsection (1) by the end of the fiscal year

• Page 3, Line 6for which it is appropriated, any amount not expended up to fifty percent

• Page 3, Line 7of the total amount appropriated is further appropriated to the department

• Page 3, Line 8for the subsequent state fiscal year for the same purpose; except that

• Page 3, Line 9money appropriated pursuant to this subsection (1) for the

• Page 3, Line 102024-25 state fiscal year is not further appropriated to the

• Page 3, Line 11department for the subsequent state fiscal year. Any

• Page 3, Line 12unexpended and unencumbered funds appropriated to the

• Page 3, Line 13department of education for purposes of this article 106 must revert to the general fund on June 30, 2025.

• Page 3, Line 14(2) (a)  In addition to the amount appropriated pursuant to

• Page 3, Line 15subsection (1) of this section, the state board of education may solicit,

• Page 3, Line 16accept, and expend public or private gifts, grants, or donations to

• Page 3, Line 17implement the institute. The state board of education shall transmit any

• Page 3, Line 18money that it receives pursuant to this subsection (2)(a) and any money

• Page 3, Line 19it receives from participating students to the state treasurer. The state

• Page 3, Line 20treasurer shall deposit the money in the Colorado student leaders institute

• Page 3, Line 21cash fund, referred to in this section as the "cash fund", which is created

• Page 3, Line 22in the state treasury. Annual operation of the institute is conditional upon

• Page 3, Line 23receiving at least forty thousand dollars in gifts, grants, or donations by

• Page 3, Line 24June 1 of each year. If on July 1, 2025, gifts, grants, donations, or

• Page 3, Line 25student contributions remain in the cash fund, the department,

• Page 4, Line 1in collaboration with the host institute and the advisory

• Page 4, Line 2committee created in section 22-106-104 (1)(c), shall return, no

• Page 4, Line 3later than August 30, 2025, to the extent possible, money

• Page 4, Line 4remaining in the fund to each grantor, donor, or student in an

• Page 4, Line 5amount that is proportional to the grantor's, donor's, or

• Page 4, Line 6student's share of the amount of gifts, grants, donations, or student contributions deposited in the cash fund.

• Page 4, Line 7(b)  The money in the cash fund is continuously appropriated to the

• Page 4, Line 8state board of education for the direct and indirect costs incurred in

• Page 4, Line 9implementing the institute to carry out this article 106. The state

• Page 4, Line 10treasurer may invest as provided by law any money in the cash fund that

• Page 4, Line 11is not expended for the purposes of this article 106. The state treasurer

• Page 4, Line 12shall credit to the cash fund all interest and income derived from the

• Page 4, Line 13investment and deposit of money in the cash fund. Any unexpended and

• Page 4, Line 14unencumbered money remaining in the cash fund at the end of a fiscal

• Page 4, Line 15year remains in the cash fund and is not credited to another fund. If any

• Page 4, Line 16money remains in the cash fund on August 31, 2025, the state

• Page 4, Line 17treasurer shall, prior to the repeal of the cash fund, transfer

• Page 4, Line 18all unexpended and unencumbered money in the cash fund to the general fund.

• Page 4, Line 19(3)  Repealed.

• Page 4, Line 20SECTION 3.  In Colorado Revised Statutes, add 22-106-106 as follows:

• Page 4, Line 2122-106-106.  Repeal of article.This article 106 is repealed, effective September 1, 2026.

• Page 4, Line 23determines, and declares that this act is necessary for the immediate

• Page 5, Line 1preservation of the public peace, health, or safety or for appropriations for
